Amendments to the Water and Sewer Management, Planning, and Boundary <br /> 12 Agreement <br /> 13 The Board considered adopting amendments to the Water and Sewer Management, <br /> 14 Planning, and Boundary Agreement (WASMPBA) map. <br /> 15 <br /> 16 BACKGROUND: <br /> 17 The Water and Sewer Management, Planning, and Boundary Agreement is was signed in 2001 <br /> 18 between Orange County, the Orange Water and Sewer Authority (OWASA), and the Towns of <br /> 19 Chapel Hill, Carrboro, and Hillsborough. The agreement (included for reference purposes as <br /> 20 Attachment 4) provides a comprehensive county-wide system of utility service areas upon <br /> 21 which signatory entities could rely when making decisions related to issues such as planning, <br /> 22 land use, annexation, zoning, and growth management. <br /> 23 <br /> 24 Potential amendments to the WASMPBA map were presented to the Board of County <br /> 25 Commissioners at the February 13, 2017 work session. The amendments currently proposed <br /> 26 for adoption include only areas south of the Hillsborough Economic Development District (EDD) <br /> 27 and areas in the vicinity of Smith Level Road in the Town of Carrboro's Extraterritorial <br /> 28 Jurisdiction. The February presentation included areas north of Chapel Hill, but Town of Chapel <br /> 29 Hill staff is currently studying those potential amendments and not ready to move forward. <br /> 30 However, Orange County and the Town of Carrboro are interested in moving forward at this <br /> 31 time with the two areas under consideration in this agenda item. <br /> 32 <br /> 33 Orange County/Hillsborough EDD Area <br /> 34 The proposed amendments in the Hillsborough EDD Area include: <br /> 35 • Designating 87.5 acres "Primary Service Area". This area is currently "Hillsborough <br /> 36 Long-Term Interest Area". Designating the area "Primary Service Area" would allow <br /> 37 extension of public water and sewer systems into the area. <br /> 38 <br /> 39 In the interest of disclosure, Orange County has received a Master Plan Development <br /> 40 conditional zoning application that includes a large portion of the area proposed to become <br /> 41 "Primary Service Area" (the area east of Old Highway 86). These WASMPBA amendments are <br /> 42 prerequisites to considering amendments to land use and zoning designations that would allow <br /> 43 for greater development potential in this general area, an area in which Orange County is <br /> 44 planning to invest approximately $1.6 million in sewer infrastructure. The area proposed for <br /> 45 addition to the Primary Service Area is serviceable by gravity sewer. <br /> 46 <br /> 47 Town of Carrboro ETJ/Smith Level Road Area <br /> 48 Town of Carrboro and OWASA staff began researching the status of this area when contacted <br /> 49 by a person interested in possibly developing in the southern portion of the area proposed for <br /> 50 "Primary Service Area" designation.
