DocuSign Envelope ID:865881 C3-FBC1-4A19-8098-B2B092F29435 <br /> 23 <br /> 7.18 No burning of refuse or debris shall be allowed inside, adjacent to, or around the Project <br /> during the course of construction without written authority from authorities having jurisdiction <br /> and the Owner. <br /> 7.19 The Design-Builder shall provide for and maintain necessary safety measures and safety <br /> programs for the protection of all persons involved with the Work. Such measures and programs <br /> shall include the requirements of the most current edition of the CAGC Safety and Health <br /> Manual [or the AGC Accident Prevention Manual in Construction], or equivalent requirements, <br /> and shall fully comply with all Federal, State, and local laws, rules, regulations, and building <br /> code requirements relating to the prevention of accidents or injuries to persons on or about the <br /> location of the Work. <br /> All trenches, excavations, or other hazards in the vicinity of the Work shall be well barricaded, <br /> and properly lighted at night. When Work requires closing of an area normally used by the <br /> Owner or the public, the Design-Builder shall furnish, erect, and maintain temporary barricades, <br /> and properly light the area. The Design-Builder shall comply with any directions and public <br /> authorities in this respect. <br /> 7.20 The Design-Builder shall designate a responsible officer or employee as safety inspector, <br /> whose duties shall include accident prevention on the Project as well as implementation of the <br /> Design-Builder's safety measures and safety programs on the Project. The name of the safety <br /> inspector shall be made known to the Owner's Authorized Representative at the preconstruction <br /> conference. <br /> 7.21 In emergencies affecting the safety of persons, the Work, or property at the Project site or <br /> adjacent thereto, the Design-Builder is obligated to act in the Design-Builder's discretion to <br /> prevent threatened damage, injury, or loss. As soon as practicable, the Design-Builder shall <br /> notify the Owner's Authorized Representative of such emergency. The Design-Builder shall give <br /> the Owner's Authorized Representative prompt written notice of any significant changes in the <br /> Work or deviations from the Contract Documents caused by such emergency. If the Design- <br /> Builder believes that additional work done in an emergency entitles the Design-Builder to an <br /> increase in the Contract Price or an extension of the Contract Time, the Design-Builder may <br /> make a claim therefore as provided in Articles 13 and/or 14. <br /> 7.22 The Design-Builder shall at all times keep the premises free from accumulation of waste <br /> materials or rubbish caused by the Work. At least weekly and at the completion of the Work, the <br /> Design-Builder shall remove all waste materials and rubbish from and about the Project. At the <br /> completion of the Work, the Design-Builder shall remove all tools, construction equipment, <br /> machinery, and surplus materials. The Design-Builder shall leave the Work in condition for <br /> occupancy by the Owner such that no cleaning or other operations are required. Material <br /> cleared from the Project and deposited on adjacent property shall not be considered as having <br /> been disposed of satisfactorily. If the Design-Builder fails to keep the Project clean of waste <br /> materials or rubbish, fails to satisfactorily clean-up weekly or at the completion of the Work, the <br /> Owner may do so and the costs thereof may be deducted from any amounts due the Design- <br /> Builder. <br /> 7.23 Utilities, temporary facilities, and signs shall be provided as described in the Contract <br /> Documents. Absent a contrary direction in the Supplementary Conditions, the Design-Builder <br /> shall pay all bills for water, electricity, or other public utility service to the Project site. <br /> Revised 2/17 <br />
