n,qF t�-apt <br /> RES-2017-031q� <br /> RESOLUTION OF AMENDMENT <br /> AN ORDINANCE AMENDING CHAPTER 24 OF THE ORANGE COUNTY CODE <br /> OF ORDINANCES AND A RESOLUTION REPEALING RESOLUTIONS 2016- <br /> 083 AND2017-018 <br /> WHEREAS, the State of North Carolina authorizes Orange County to impose impact fees through <br /> Title VI of Chapter 460 of the Session Laws of 1987, as amended by Chapter 324 of the Session <br /> Laws of 1991 and Part 4 of Chapter 642 of the Session Laws of 1993; and <br /> WHEREAS, the General Assembly is considering amending the County's authority to impose <br /> impact fees through House Bills 406 and 436; and <br /> WHEREAS, in order to study how best to remain in compliance with the proposed laws and to study <br /> issues raised by the General Assembly and collect further data; and <br /> WHEREAS, the Orange County Board of Commissioners, believing it to be in the best interest of <br /> the citizens and residents of Orange County, hereby determines that Chapter 30 of the Orange <br /> County Code of Ordinances should be amended to repeal the impact fee amounts adopted on <br /> November 15, 2016 and . <br /> NOW THEREFORE BE IT ORDAINED that the Code of Ordinances, Orange County, North <br /> Carolina, Chapter 30, by majority vote of the Orange County Board of Commissioners, is hereby <br /> amended by amending section 30-33, which section reads as shown in the attached revised <br /> ordinance amending the Educational Facilities Impact Fee in Orange County. <br /> BE IT FURTHER RESOLVED, that Resolutions 2016-083 and2017-018 adopted on December 13, <br /> 2016 and April 4, 2017, respectively, are hereby repealed. <br /> BE IT FURTHER RESOLVED that the County Manager is authorized to refund that portion of any <br /> impact fees paid between January 1, 2017 and May 16, 2017 that exceeds the amount of impact <br /> fees that would have been paid for the same project on January 1, 2012. <br /> This Amendment shall become effective upon adoption. <br /> Adopted by the Orange County Board of Commissioners this 16th day of May, 2017. <br /> By: Attest: <br /> x6a,/— I -S % . ......... <br /> Mark Dorosin, Chair Donna Baker, Cier <br /> Orange County Board of Commissioners <br /> ,r <br />
