46 <br /> bicycle upon a highway shall be subject to the provisions of this Chapter <br /> applicable to the driver of a vehicle except those which by their nature can <br /> have no application. This term shall not include a device which is designed <br /> for and intended to be used as a means of transportation for a person with a <br /> mobility impairment, or who uses the device for mobility enhancement, is <br /> suitable for use both inside and outside a building, including on sidewalks, <br /> and is limited by design to 15 miles per hour when the device is being <br /> operated by a person with a mobility impairment, or who uses the device for <br /> mobility enhancement. This term shall not include an electric personal <br /> assistive mobility device as defined in G.S. 20 11.01(7a).subdivision (7b) of <br /> this section. <br /> SECTION 13.(b) G.S. 20-10.1 reads as rewritten: <br /> "§ 20-10.1. Mopeds. <br /> It shall be unlawful for any person who is under the age of 16 years to operate a moped as <br /> defined in G.S. 105 16'1.3 G.S. 20-4.01(27)dl. upon any highway or public vehicular area of <br /> this State." <br /> SECTION 13.(c) G.S. 20-171.1 reads as rewritten: <br /> "§ 20-171.1. Definitions. <br /> As used in this Part, except where the context clearly requires otherwise, the words and <br /> expressions defined in this section shall be held to have the meanings here given to them: <br /> Bicycle. — A nonmotorized vehicle with two or three wheels tandem, a steering handle, one <br /> or two saddle seats, and pedals by which the vehicle is propelled-propelled, or an electric <br /> assisted bicycle, as defined in G.S. 20-4.01(7a)." <br /> SECTION 13.(d) G.S. 20-175.6 reads as rewritten: <br /> "§ 20-175.6. Electric personal assistive mobility devices. <br /> (a) Electric Personal Assistive Mobility Device. — As defined in <br /> 20 11.01(7a).G.S. 20-4.01(7b). <br /> SECTION 13.(e) Reserved. <br /> SECTION 13.(f) G.S. 58-37-1 reads as rewritten: <br /> "§ 58-37-1. Definitions. <br /> As used in this Article: <br /> (6) "Motor vehicle" means every self-propelled vehicle that is designed for use <br /> upon a highway, including trailers and semitrailers designed for use with <br /> such vehicles (except traction engines, road rollers, farm tractors, tractor <br /> cranes, power shovels, and well drillers). "Motor vehicle" also means a <br /> motorcycle, as defined in G.S. 20-4.01(27)d. "Motor vehicle" does not mean <br /> a moped, as defined in G.S. 105 16'1.3. G.S. 20-4.01(27)dl., or an electric <br /> assisted bicycle, as defined in G.S. 20-4.01(7a). Notwithstanding any other <br /> provisions of this Article, liability insurance on a moped is not eligible for <br /> cession to the Facility. <br /> SECTION 13.(g) Reserved. <br /> SECTION 13.(h) G.S. 105-164.3 reads as rewritten: <br /> "§ 105-164.3. Definitions. <br /> The following definitions apply in this Article: <br /> (22) Moped.— • -• - - - - -- .. -- , . - -- . - - • -, <br /> and a motor that does not exceed 50 cubic centimeters piston displacement <br /> and cannot propel the vehicle at a speed greater than 30 miles per hour on a <br /> level surface.As defined in G.S. 20-4.01(27)dl. <br /> SECTION 13.(i) G.S. 20-51(14)reads as rewritten: <br /> "§ 20-51.
