38 <br /> 26 <br /> provide said accounting records, and any and all other records requested, to Owner for <br /> purposes of performing an audit or any other purpose. <br /> ARTICLE 8. OWNER <br /> 8.1 The Owner shall issue communications and notices to the Design-Builder through the <br /> Owner's Authorized Representative to the extent contemplated by the Contract Documents. <br /> 8.2 In case of termination of the employment of the Owner's Authorized Representative, the <br /> Owner shall appoint as Owner's Authorized Representative a qualified person who shall have <br /> and assume all rights and duties held by the original Owner's Authorized Representative. <br /> 8.3 The Owner shall have the right to take possession of and use any portion of the Work <br /> notwithstanding the fact that the time for completion of such portion of the Work may not have <br /> expired, but such taking possession and use shall not be deemed an acceptance of any Work <br /> not completed in accordance with the Contract Documents. <br /> 8.4 A waiver on the part of the Owner of any breach of any part of the Design-Builder shall not <br /> be held to be a waiver of any other or subsequent breach. <br /> 8.5 The Owner shall pay all permanent acreage fees, governmental impact fees, and meter <br /> deposits for permanent utilities. <br /> 8.6 Owner reserves the right to engage in or contract for construction activities related to the <br /> Project with Owner's employees or contractors. The Design-Builder shall maintain responsibility <br /> for coordinating these Owner performed activities with the Work. <br /> 8.7 Owner shall have access to the Work and Project at all times and locations. Owner shall <br /> comply with Project safety criteria during any such access. <br /> ARTICLE 9. AUTHORIZED REPRESENTATIVE <br /> 9.1 The Owner's Authorized Representative is charged with the responsibility of interpretation of <br /> the Contract Documents. The Owner's Authorized Representative's decisions relating to <br /> aesthetic matters shall be final. <br /> 9.2 All Work completed under the Contract Documents shall be subject to review by the <br /> Owner's Authorized Representative. No Work is to be covered without the Owner's Authorized <br /> Representative's review or prior authorization. <br /> Any Work so covered without the Owner's Authorized Representative's review or prior <br /> authorization shall be uncovered to the extent required by the Owner to perform an adequate <br /> and,proper inspection at the Design-Builder's expense. The Design-Builder shall notify the <br /> Owner's Authorized Representative in writing at least twenty-four (24) hours in advance of <br /> covering any Work. <br /> 9.3 The Owner's Authorized Representative shall not be responsible for the construction means, <br /> methods, techniques, sequences, procedures, or the safety precautions and programs incident <br /> thereto, and shall not be responsible for the Design-Builder's failure to perform the Work in <br /> accordance with the Contract Documents, but shall be entitled to enforce any requirements in <br /> Revised 2/17 <br />
