<br />    		7.24 The Design-Builder shall indemnify and hold the Owner, the Owner's 's consultants, and its
<br />    		officers, agents, and employees harmless against all costs, damages, and expenses, including
<br />    		attorney's fees and costs of defense, arising out of claims by any Subcontractor, sub-
<br />    		subcontractor, or supplier engaged by or employed by the Design-Builder or employed by any of
<br />    		the Subcontractors claiming through it, including without limitation damages, losses, and
<br />    		expenses arising out of or relating to any inconvenience, delay, interference, or other action or
<br />    		non-action of the Design-Builder or the Design-Builder's Subcontractors on the Project.
<br />    		7.25 Prior to completion of the Work and Final Payment of the Contract Price, excepting only
<br />    		those portions of the Work deemed accepted in accordance with the Contract Documents, the
<br />    		Design-Builder shall have charge and care of the Work, and shall take every precaution against
<br />    		injury or damage to any part due to the action of the elements or from any other cause, whether
<br />    		arising from the execution or from the non-execution of the Work. The Design-Builder shall as
<br />    		required by the Owner replace, rebuild, repair, restore, and make good all injury or damage to
<br />    		any portion of the Work occasioned by any of the above causes before Final Completion and
<br />    		shall bear the expenses thereof.
<br />    		7.26 In the event that the Work, or any portion thereof, is suspended at any time pursuant to an
<br />    		order of the Owner, the Design-Builder shall obey all instructions of the Owner regarding
<br />    		storage of materials, drainage, protection of the Work, and erection of temporary structures
<br />    		during the suspension period.
<br />    		7.27 The Design-Builder shall be required to notify the Owner's Authorized Representative
<br />    		promptly of any event or condition which could affect the conduct or progress of the Work and
<br />    		shall cooperate fully with all other Owner's Authorized Representative on the Project site.
<br />    		7.28 All Work performed pursuant to the Contract Documents shall conform in all respects to the
<br />    		North Carolina State Building Code and all other state, local, and national codes in effect at the
<br />    		time of and applicable to this Work.
<br />    		7.29 The Design-Builder shall provide for and maintain necessary safety measures and safety
<br />    		programs for the protection of all persons at the Project site, and shall comply at all times with
<br />    		the requirements of the most current edition of the CAGC Safety and Health Manual [or the
<br />    		AGC Accident Prevention Manual in Construction], or the equivalent requirements of the
<br />    		Design-Builder's safety program, and shall fully comply with all Federal, State, and local laws,
<br />    		rules, regulations, and building code requirements so as to prevent accidents or injuries to
<br />    		persons on or about the Project site. The Design-Builder shall clearly mark or post signs
<br />    		warning of existing hazards, and shall barricade excavations, elevator shafts, stairways, and
<br />    		similar hazards. The Design-Builder shall protect against damage or injury resulting from falling
<br />    		materials, and shall maintain all protective devices and signs throughout the progress of the
<br />    		Work.
<br />    		7.30 The Design-Builder shall adhere to the rules, regulations, and interpretations of the North
<br />    		Carolina Department of Labor's Occupational Safety and Health Standards for the Construction
<br />    		Industry (29 CFR Part 1926 as adopted in 13 NCAC 07F.0201, including 29 CFR Part 1910
<br />    		General Industry Safety and Health Standards applicable to construction) and N.C. Gen. Stat.
<br />    		§95-126 through 155 (Occupational Safety and Health) as well as all revisions and amendments
<br />   		to such standards or statutes as may occur throughout the performance of the Work.
