29 <br /> 17 <br /> Builder shall submit samples in quantities required by the Contract Documents. The Design- <br /> Builder shall submit product data in at least five (5) copies. All shop drawings shall be reviewed <br /> by the Design-Builder and shall bear the Design-Builder's stamp of approval before being <br /> forwarded to the Owner's Authorized Representative. Submittals shall be submitted in such time <br /> as to cause no delay to the Work or any part thereof and in accordance with the Contract <br /> Construction Schedule and Submittal Register. The Owner's Authorized Representative shall <br /> review the submittal with reasonable promptness, noting desired corrections, if any. The <br /> Owner's Authorized Representative shall retain two (2) copies of the submittal and shall return <br /> the balance of the reviewed submittal to the Design-Builder for action. The Design-Builder shall <br /> furnish any corrected submittal to the Owner's Authorized Representative. The Owner's <br /> Authorized Representative shall retain two (2) copies of the corrected submittal and will return <br /> the balance of the reviewed submittal to the Design-Builder. All substitutions shall be in <br /> accordance with the Contract Documents. <br /> The Design-Builder acknowledges that the processing of drawings and other submittals is <br /> directly impacted by the clarity, completeness, and accuracy of said documents and that it is the <br /> Design-Builder's responsibility to (i) review and coordinate each submittal with all other related <br /> or affected Work and (ii) approve each submittal before submitting same to the Owner's <br /> Authorized Representative for approval. <br /> 6.2 No substitutions and no deviations from any requirement of the Contract Documents shall <br /> be deemed allowed unless the Design-Builder has specifically informed the Owner in writing of <br /> such deviations at the time of submittal and the Owner has given written and specific approval <br /> to the substitutions or deviations. In proposing a deviation or substitution the Design-Builder <br /> warrants to the Owner, notwithstanding any review, allowance or approval by the Owner's <br /> Authorized Representative or the Owner that the deviation or substitution is at least equal to or <br /> better in quality and for the purpose intended, and that Design-Builder shall not by reason of any <br /> such review, allowance or approval be relieved from any obligation or responsibility contained in <br /> the Contract Documents. <br /> 6.3 Review of submittal by the Owner's Authorized Representative shall not be construed as <br /> relieving the Design-Builder from responsibility for compliance with terms or designs of the <br /> Contract Documents nor from responsibility for errors of any sort in the submittal. <br /> 6.4 The Design-Builder shall keep one record copy marked "As-Built" of all Specifications, <br /> Drawings, Addenda, Modifications, and Submittals at the Project in good order and annotated at <br /> least monthly to show all changes made during the construction process. Such monthly <br /> annotations and their approval by the Owner's Authorized Representative shall be a condition <br /> precedent to approval by the Owner's Authorized Representative of each monthly Request for <br /> Payment. Said record copy shall be stored at the Project and fully protected from damage by <br /> fire or other hazard. This record copy shall be available to the Owner's Authorized <br /> Representative for inspection at all times and shall be delivered to the Owner's Authorized <br /> Representative for the Owner's purposes prior to the Owner's Authorized Representative's <br /> certifying Substantial Completion of the Work. <br /> 6.5 At completion of the Project and before Final Payment, the Design-Builder shall assemble <br /> and deliver to the Owner one complete set of all as-built drawings and one complete set of all <br /> approved submittals, product data, and samples which were reviewed by the Owner's <br /> Authorized Representative.
