I assume that <br /> what I am being asked to do Is only to draft the necessary <br /> legislation to implement this program and not other <br /> ordinances or policies that could be adopted by the county <br /> board of commissioners or the county administration. (I <br /> would belhappy to draft those ordinances or policies as well, <br /> but I dolnot understand your request to include these <br /> document's.) Based on this assumption, I concur with the <br /> summary contained on page 12 of the 1-14-83 draft, which <br /> indicates the need for the following four pieces of <br /> legislation: <br /> (1) General legislation is required to establish the prefer- <br /> ential taxation aspect of the farm preservation program. <br /> 4 <br /> This legislation presents the most substantial drafting <br /> problem and most of my time will, therefore be spent on this <br /> subject. <br /> (2) Local legislation will be needed to deal with the some- <br /> . what related question of exemption from special assessments <br /> for watei and sewer improvements for properties participating <br /> in the farm preservation program. <br /> (3) General legislation will be needed to provide for the <br /> assessment of attorney's fees against plaintiffs who initiate <br /> frivolous nuisance litigation against owners of property <br /> engaged in protected uses. <br /> (4) Special legislation will be necesary to require that <br /> deeds transferring property within 600 feet of bone fide farm <br /> tracts and within one-half mile of all poultry, swine, or <br /> k <br /> • <br />
