e • <br /> 20 <br /> (b) On a periodic basis, subject to the Board of Commissioners <br /> direction; <br /> (c) Whenever a petition is filed with the Inspector by a public <br /> authority or by at least five (5) residents of the County charging that any <br /> dwellingi or dwelling unit contains conditions that do not meet the minimum <br /> standards contained in this ordinance. <br /> 14.2 The owner and occupant of every dwelling, dwelling unit, rooming house <br /> and rooming unit, or the person in charge thereof, shall give the Inspector free <br /> access to such dwelling, dwelling unit, rooming house or rooming unit and its <br /> premises at all reasonable times and in a reasonable manner for the purposes of <br /> such inspection, examination and survey. Consent of the occupant in actual <br /> possession or control of the premises shall be sufficient permission to the <br /> Inspector to enter upon the premises. Whenever the Inspector is denied permission <br /> to enter upon and inspect the premises, by the occupant, the Inspector may obtain <br /> a warrant authorizing him to conduct such inspection of the premises as <br /> authorized by North Carolina General Statutes Section 15-27.2. <br /> 14.3 Every occupant or person in possession of a dwelling, dwelling unit, <br /> rooming house or rooming unit shall give the owner thereof, or his agent or <br /> employee, access to any part of such dwelling or dwelling unit and its premises at <br /> reasonable times and in a reasonable manner for the purpose of making such <br /> repairs and thterations as are necessary to effect compliance with the standards <br /> contained in his ordinance or with any lawful order issued pursuant to the <br /> provisions of his ordinance. <br /> Article 15. Procedure for Enforcement. <br /> 15.1 Whenever it appears to the Inspector that any dwelling or dwelling <br /> unit does not meet minimum standards contained in this ordinance, he shall issue <br /> and cause to be served upon the owner of the parties in interest in such dwelling <br /> or dwelling unit a complaint stating the charges and containing a notice that a <br /> hearing will be held before the Inspector at a place therein fixed, not less than <br /> ten (10) nor More than thirty (30) days after the serving of the complaint. The <br /> owner or any party in interest shall have the right to file an answer to the <br /> complaint ail to appear in person, or otherwise, and give testimony at the place <br /> and time fixed in the complaint. Notice of such hearing shall also be given to at <br /> least one of the persons signing a petition relating to such dwelling. Any person <br /> desiring to do so may attend such hearing and give evidence relevant to the <br /> matter being Peard. The rules of evidence prevailing in the courts of this State <br /> shall not be dontrolling in hearings before the Inspector. <br /> 15.2 After such notice and hearing, the Inspector shall state in writing his <br /> determination whether the dwelling or dwelling unit complies with the minimum <br /> standards contained in this ordinance, and if not, whether it is deteriorated or <br /> dilpidated. <br /> (a) If the Inspector determines that the dwelling or dwelling unit is <br /> deteriorated, he shall state in writing his findings of fact in support of such <br /> determination, and shall issue and cause to be served upon the owner thereof <br /> an order l directing and requiring the owner to repair, alter, or improve such <br /> dwelling or dwelling unit to comply with the minimum standards contained in <br /> -9- <br /> - <br />
