If the said premises be destroyed by fire or other casualty, <br /> A1vithout fault of the Lessee, this sublease shall immediately terminate and <br /> the rent shall be apportioned to the time of the damage. In case of partial <br /> destruction or damage by fire or other casualty without fault of the Lessee, <br /> so as to render the premises untenantable in whole or in part, there shall <br /> - bean apportionment of the rent until the damage has been repaired. During <br /> such period of repair, Lessee shall have the right to obtain similar office <br /> space at the expense of Lessee or the lessee may terminate the sublease by <br /> giving fifteen (15) days written notice to the Lessor. <br /> 8. Lessor shall be liable to Lessee for any loss or damages <br /> suffered by Lessee which are a direct result of the failure of Lessor to <br /> perform an act required by this sublease, and provided that Lessor could <br /> reasonably have complied with said requil-erenti The Lessee agrees to indemnify <br /> and save harmless the Lessor and the agents, servants and employees of the <br /> Lessor against and from any and all claims by or on behalf of any person, firm <br /> or corporation arising by reason of injury to person or damage to property <br /> occurring in the subleased premises occasioned in whole or in part by any <br /> act on the part of the Lessee or an employee while acting within the scope <br /> of employment, agent or visitor of the Lessee or by reason of any unlawful <br /> use of the Subleased premises or any breach, violation or non-perfomance of <br /> any covenant in this sublease on the part of the Lessee to be observed or <br /> performed, and also for any matter or thing growing out of the occupancy or <br /> use of the subleased premises by the Lessee. Lessee agrees to pay for all <br /> damages to the building beyond reasonable wear as well as all occupants <br /> thereof, caused by Lessee's misuse or neglect of said subleased premises, <br /> its apparati* or appurtenances. Lessor shall not be liable to Lessee for <br /> any damage by or from any act or negligence of any other occupant of the <br /> building or by any owner or occupant of adjoining contincus property. <br /> 9. The Lessee agrees that the Lessee shall not do, or cause to be <br /> done, or permit on the subleased premises anything deemed extra hazardous <br /> on account of fire. Lessor shall carry fire and extended coverage insurance <br /> insuring its interest in the building and the subleased premises. Lessee <br /> shall carry fire and extended coverage insurance insuring its interest, if <br /> any, in inprOvemnts to or in the subleased premises and its interest in its <br /> office furniture, equipment, supplies and other personal property. Lessee <br /> is self-insured. Both the Lessor and the Lessee hereby waive any claims or <br /> rights or action which the one may have against the other for loss or damage <br /> covered by sdch insurance and both the Lessor and reqsee covenant and agree <br /> that each of than will obtain a waiver from its carrier of such insurance <br /> releasing such carrier's subrogation rights as against the other party. <br /> 10. i Upon termination of this lease, the Lessee will peaceably <br /> . , surrender the subleased premises in as good order and condition as when <br /> received, reasonable use and wear and damage by fire, war, riots, insur- <br /> rection public calamity, by the elements, by act of God, or by circumstances <br /> over which the Lessee had no control or for which Lessor is responsible <br /> pursuant to this sublease, excepted. <br /> wir. ____ <br />
