6. The County shall develop, program, install and test the 68 <br /> required software to process student records of the Board as out- <br /> lined in the attached document entitled "ORANGE COUNTY STUDENT <br /> RECORDS". The Board will furnish the County with a magnetic tape <br /> of scheduled students which will become the input to the STUDENT <br /> RECORDS SYSTEM. The County agrees to provide disc capacity for <br /> all students records, grades six through twelve. Info... •11 wi <br /> be recorded on the County system but will be acces and maintain-d <br /> by the Board's staff through a terminal located-- t the Board's cen <br /> tral office. The County will bill the Board-for the actual cost o. <br /> developinglthis software system but this cost shall not exceed <br /> $3,000. Programming additional to that necessary for the develop- <br /> ment of this software system will be charged to the Board at a rat- <br /> of $20 pert hour. The hourly charge may be adjusted at the end of <br /> each year f the agreement to reflect increases in cost. This ad- <br /> justment m y not exceed 5% per year. <br /> 7. Any programs developed and owned by the County as describ-d <br /> in Paragraph 6 above may be sold by the County. In the event of s eh <br /> sale the proceeds received shall first be used to pay back the 130.t d <br /> of Educatibn for the cost charged it for software development. T :s <br /> cost paid hall not exceed $3,000. <br /> 8. The County shall provide required operator training for --ch <br /> program to be used by the Board. Such operator training shall be <br /> available hs required by the Board for the life of this agreement at <br /> no additional cost to the Board. <br /> 9. The County agrees that its staff understands the data on any , <br /> student is privileged and understands that this information is pr.- <br /> tected by the Family Educational Rights and Privacy Act, and is, <br /> therefore,1 privileged information to be kept confidential at all ..imes. <br /> The County; will exercise its best efforts to ensure the confident'ality <br /> of these records at all times. The County will not, nor will it .-rmit <br /> or allow users other than the Board to access, view, review disclise <br /> or provid such records to any person or entity, including the Co nty, <br /> except as pay be necessary by the County in the performance of se.vices <br /> pursuant to this agreement. <br /> 10. Tpe County shall provide necessary communication linkage <br /> between the Board's Central Office and the Orange County Data Pro <br /> cessing Center. <br /> 11. The County shall provide all installation and have all e' ip- <br /> ment and Software programs operational with the operator training <br /> complete by rciorKbarclIGITet-/ . In the event the system is not fu c- <br /> ° tional by the abov d7 the County shall refund a prorate share of <br /> the monthly cost based upon the number of working days in the month <br /> that portion of the system is not functional. <br /> 12. Subsequent to initial installation, the County shall pro ide <br /> the Board with the same level of service as other users of the Or.nge <br /> County Data Processing Center, including priority usage equal to • at <br /> of other users. <br />
