Grading Permits expire if the land disturbing activity does <br /> not begin within 6' months of the date of issuance. <br /> The land disturbing activity is considered to have started <br /> when the necessary erosion control practices have been <br /> properly installed and the site clearing or grading has <br /> begun. <br /> 17e. The County may establish such fees as considered necessary <br /> to defray costs of administering this ordinance. <br /> 17f. Whenever a person engaged in a land-disturbing activity <br /> is not complying with the provisions of this ordinance, <br /> the Grading Permit, the Approved Erosion Control Plan <br /> or any amendments to the Plan, the Erosion Control Officer <br /> may revoke the Grading Permit for the site. Notice of <br /> Revocation shall be sent by registered or certified mail <br /> to the person responsible for the land-disturbing activity., <br /> In the event delivery cannot be accomplished be registered <br /> or certified mail, it may be accomplished in any manner <br /> provided in Rule 4 (j) of the North Carolina Rules of <br /> Civil Procedure. Upon receipt of the Revocation Notice, <br /> the person responsible must immediately order all land <br /> disturbing activities to cease except those activities <br /> which are specifically directed towards bringing the <br /> site into compliance. Once the site has been inspected <br /> and remedial work approved by the Erosion Control <br /> Division, the responsible party may re-apply for a <br /> Grading Permit and pay the appropriate fee. Resumption <br /> of land disturbing activities other than those necessary <br /> to bring the site back into compliance before the reissuance <br /> of the Grading Permit will consititute a violation of the <br /> Ordinance. The person responsible for the land-disturbing <br /> activity may appeal the revocation of a grading permit <br /> following procedures set out in Section 21f of this <br /> Ordinance, <br /> Section 18 Erosion and Sedimentation Control Plans. <br /> a, An Erosion Contnm1PIan shall be prepared for all land- <br /> disturbing activities subject to this ordinance whenever <br /> the proposed activity is to be undertaken on a tract <br /> comprising more than 20,000 square feet, if more than <br /> 20,000 square feet is to be uncovered. The Plan shall <br /> be filed with the Erosion Contrl Officer and the Orange <br /> Soil and Water Conservation District, 30 days prior to <br /> the commencement of the proposed activity. <br /> If the land disturbing activity involves 20,000-40,000 <br /> square feet and meets the requirements under Section <br /> 17b, the Applicant may apply for a Plan Wavier, which <br /> does not require a formal Erosion ContrOl%Plan. <br /> b.
