39 <br /> NOTICE OF PUBLIC HEARING ON PROPOSED AMENDMENTS <br /> TO THE SEDIMENTATION AND EROSION CONTROL ORDINANCE <br /> OF ORANGE COUNTY, NORTH CAROLINA <br /> Pursuant to the requirements of the General Statutes of North Carolina, <br /> Chapter 113A SeCtion 60 and Title 15, Chapter 4 of the North Carolina Administrativ- <br /> Code, notice is hereby given that a public hearing will be :Jeld in the Superior <br /> Courtroom of the Orange County Courthouse, 106 East Margaret Lane, Hillsborough, <br /> N.C. on Monday, November 28, 1983, at 7:30 P.M. for the purpose of giving all <br /> interested citizens an opportunity to speak for or against the adoption of proposed <br /> amendments to the Orange County Sedimentation and Erosion Control Ordinance. <br /> The amendments under consideration are as follows: <br /> Section 6 General Requirements <br /> 1 <br /> a. Section 6c of existing ordinance. <br /> b. Erosion Control Plan Requirement. Prior to the commencement <br /> I of any land disturbing activity that will result in the <br /> uncovering of more than 20,000 square feet of land, the person <br /> ! responsible for the land disturbing activity, the land owner,or <br /> his/her agent must prepare and submit an Erosion Control Plan <br /> for the proposed site. The Erosion Control Officer may, at hist <br /> her discretion, grant a Plan Waiver if the amount of disturbance <br /> is between 20,000 and 40,000 square feet, the site conditions <br /> warrent it and the disturbance is not directly adjacent to a <br /> sensitive area. <br /> Section 17 Permits <br /> a. No Person shall undertake any land-disturbing activity which <br /> would result in the uncovering of 20,000 square feet or more <br /> of land without first obtaining the required approvals and <br /> permits from the Erosion Control Officer. Land disturbing <br /> activities listed under Section 5d must obtain the appropriate <br /> Erosion Control Plan Approval from the State;however, these <br /> land-disturbing activities require a Grading Permit from the <br /> County when the amount of disturbance is greater. thant 20,000 <br /> square feet, Permit Application forms must be signed by the <br /> .landowner or his/her authorized agen , "The-agent-signing must have <br /> a signed letter of authorization from the owner. <br /> b. Erosion Control Plan Approvals and Plan Waivers <br /> An Erosion Control Plan must be submitted to the Erosion <br /> 11 Control Officer when the proposed land disturbance is <br /> greater than 20,000 square feet. However, at the discretion <br /> of the Erosion Control Officer a Plan Waiver may be granted <br /> when the disturbance is between 20,000 and 40,000 square <br /> feet, site conditions warrant it, and the disturbance is <br /> not directly adjacent to a sensitive area. The application <br /> for a Plan Waiver must contain sufficient information about <br /> the proposed site for the Erosion Control Officer to deter- <br /> mine if granting a Waiver is justified. <br /> C. Before starting a land-disturbing activity greater than 20,000 <br /> square feet, the owner or his/her.agent shall obtain a Grading <br /> i <br /> Permit from the Erosion control Officer. Erosion Control, <br /> 1 Plans or Plan Waivers must be approved before a Grading Permit <br /> will be issued. <br /> 1 Grading Permits may be obtained when the Plan or Waiver is <br /> approved or prior to the start of the land disturbance. <br /> id. Expiration of Permits <br /> Erosion Control Plan Approvals and Plan Waivers expire if <br /> the land disturbing activity is not begun within 6 months <br /> of the approval date. All Erosion Control Plans approved <br /> prior to the adoption of this amendment will expire 6 months <br /> after the adoption if the land disturbing activity has not <br /> begun by that date. <br />
