602 <br /> • <br /> Item 5 is a stormwater management specific provision which is <br /> not paralleled anywhere in the existing County Sedisentation and <br /> Erosion cOnto2 Ordinance or Zoning Ordinance. <br /> ADDITION: Section 6.1 General Requirements <br /> Commentr. The Proposal calls for approval of an erosion control plan for every <br /> land disturbing activity of more than 10,000 square feet; the county <br /> currently requires plan approval for activities greater than 40,000 <br /> square feet. <br /> Section f34) and b) qualify the enforcement :policy by specifyinYstorm- <br /> water management provisions. Item (d) enforcement should be linked with <br /> zoning enforcement. <br /> The section does, not address the administrative mechanism for obtaining <br /> or qualifying for either Plan Approva/s6m&remptions: Difficulties <br /> arise in terms of monitoring activities, channeling o' complaints, <br /> criteria for approvals, streamTining Aer4f.istrative procedures for the <br /> citizens of Carrhcorm etc. <br /> ADDITION: Section 8.1 Additional Standards <br /> Comment: Item a) is a stormwater6management provision. <br /> Item h) is more appropriately a zoning requirement enforced by <br /> the local staff. <br /> Item 5's final sentences would be difficult to enforce as it assumes <br /> all property owners are aware of the classification of the water body <br /> crossing their property and the prohibition regarding removal of existing <br /> natural vegetation, a matter of private right as long as land-disturbing <br /> activity does not take place. <br /> Item j) and b) are stormwater management provisions: <br /> ADDITION: Seaton' 9 <br /> . comment: Item a) is a stormwater management provision. <br /> ADDITION: Seaion 11 - Access and Haul Roads <br /> Comment: 2738.1 I additional wording permits only one..metbod of addressing the <br /> concern regarding such roads. The SpeCification andibr 'imitation <br /> of techniques is not found elsewhere in the ordinance. <br /> ADDITION: Section 13,1 <br /> 1 <br /> ' Comment: This section is a stormwater management provision. <br /> Section 17 <br /> Comment: IteM i) conflicts with Section 6.1 General Requirements.as it references <br /> that applidation of the ordinance is for any land-disturbing- activity. <br /> Further, later reference to required plan approvals effectively prohibits <br /> the SE officer from requiring plan approvals for activity less than <br /> 40,000 square feet in size at his discretion and under certain conditions. <br />
