Wayne Weston <br /> August 12 , 1983 <br /> Page 2 <br /> Both the 0 . 77 acre and 0. 87 acre tracts, described <br /> above, adjoined an 8 .00 acre tract of land which the Board <br /> of Eduction had acquired by judgment from Elsie Torain on <br /> April 21, 1948 . All three (3) tracts comprised the site <br /> of the aid Cedar Grove Elementary School. <br /> On March 2 , 1976, according to the official Minutes of <br /> the Orange County Board of Education, the Orange County <br /> Board ofi Commissioners was invited to inspect the entire <br /> 9 .64 acre tract of land and the building thereon containing <br /> 32 ,630 square feet for possible purchase by the County. At <br /> that meeting, the Vice-Chairman of the County Commissioners <br /> stated that the Commissioners would inspect the property, <br /> known as the old Cedar Grove Elementary School and meet <br /> with I <br /> the; Board of Education at a later date to discuss <br /> • <br /> possible purchase. Thereafter, on March 30 , 1976, the <br /> Board of Education received a letter from the Orange County <br /> Manager 1 stating that the Orange County Board of <br /> Commissidners would like to acquire the Cedar Grove School <br /> property and asking that attorneys for both the Board of <br /> County Commissioners and the Board of Education take <br /> necessary actions to effect the transfer of this property <br /> as soon as possible. The Board of Education voted <br /> unanimously to give the Cedar Grove property to the County <br /> Commissioners and directed its superintendent to have the <br /> necessary legal actions taken. <br /> At is meeting on July 6 , 1976 , the superintendent of <br /> schools presented to the Board of Education a deed prepared <br /> by the Board's attorney (prior to the time this firm became <br /> counsel to the Board of Education) for the transfer of the <br /> Cedar Groye School property. However, that deed did not <br /> contain the stipulation that, should the property cease to <br /> be used f4 public purposes, it would revert to the Board <br /> of Education. Following discussion, the Board directed the <br /> deed to be revised to contain that stipulation. <br /> Thereafter at its meeting on August 2, 1976, the newly <br /> drawn dee1 for the transfer of the Cedar Grove School <br /> property to the Orange County Board of Commissioners was <br /> approved and forwarded to the Commissioners. <br /> Unfortunately, as you are aware, during the course of <br /> these various deliberations, the deed was improperly drawn <br /> to only transfer the 8 .00 acre tract, rather than the <br /> entire 9 .64 acres, as clearly intended by the Orange County <br /> Board of Education.
