00' <br /> maintained or permitted by the animal's owner or keeper shall constitute a public <br /> nuisance whether said acts are committed on or off the premises of the owner or <br /> keeper. <br /> (a) The animal is repeatedly found at large off the premises of its <br /> owner or keeper and not under the restraint of a competent person. <br /> (b) The animal repeatedly damages the property of anyone other <br /> than its owner or keeper, including, but not limited to, turning over garbage <br /> containers or damaging gardens, flowers, shubbery, vegetables or trees. <br /> (c) The animal is vicious. <br /> (d) The owner or keeper maintains an animal in an environment <br /> which would constitute "cruel" treatment. <br /> (e) The animal barks, whines, or howls habitually and repeatedly. <br /> a <br /> (1) The animal is diseased and dangerous to the public health. <br /> (g) The animal habitually or repeatedly chases, snaps at, attacks <br /> or barks at pedestrians, bicycles or vehicles and is not in an enclosure, chained <br /> or on the owner's or keeper's property. <br /> (h) The owner or keeper falls to confine a female dog while in <br /> heat (estrus) 'in a building or secure enclosure in such a manner that she will not <br /> 8 be in contact with another dog, nor attracting other animals; provided, this <br /> section shall not be construed to prohibit the intentional breeding of animals <br /> within an enclosed area on the premises of the owner or keeper of an animal <br /> involved in the breeding process. <br /> 16.1 Restraint: A dog is under restraint if it is controlled by means <br /> of a chain, leash or other like devise; is under direct control and is obedient to <br /> commands; is on or within a vehicle being driven or parked; or is within a secure <br /> enclosure. <br />
