. . <br /> _ <br /> , . <br /> : <br /> ; <br /> STATE AND SERVICE DELIVERY AREA <br /> MEMORANDUM OF AGREEMENT <br /> ARIICLE I: Acceptance of Service Delivery Area De.AgEltio!i_ <br /> The signators to this agreement acknowledge that the Governor has <br /> deignated the City of Durham and the Counties of Chatham, Durham <br /> and Orange <br /> (Local Governmental Unit(S) as the Central Piedmont Employment & Trainji <br /> —.— <br /> Service Delivery Area, hereinafter referred to as the SDA, in accord- <br /> ancle with his authority under the Job Training Partnership Act , <br /> 97-300, hereinafter referred to as the Act, and hereby accept <br /> such designation. <br /> ARTICLE II : Assurances by the SDA <br /> As the designated Chief Elected Official authorized to represent <br /> the units(s) of local government within this SDA, I assure and certify <br /> that: <br /> A. We will comply with the requirements of the Act and <br /> regulations promulgated thereunder, all other applicable <br /> Federal Regulations, the Statutes of the State of North, <br /> Carolina, written directives, guidelines, and instructions <br /> of the North Carolina Department of Natural Resources and <br /> Community Development, Division of Employment and Training. <br /> B. We will appoint a Private Industry Council in accordance <br /> with applicable provisions of Section 102 of the Act. <br /> C. We will enter into an agreement with the Private Industry <br /> Council in accordance with Section 103 of the Act. <br /> D. We will approve and submit, jointly with the Private industry <br /> Council, the Job Training Plan for this SDA. <br /> E. The Unit(s) of Local Government in this SDA (in accordance <br /> with its consortium agreement, if the SDA is composed of <br /> a consortium of Units of Local Government) accept joint <br /> and several liability for all activities carried out under <br /> the Act and all, funds received under the Act. <br /> • <br /> ARTICLE III: Assurances by the State <br /> On behalf of the Governor of the State of North Carolina, the <br /> Division of Employment and Training assures and certifies that: <br /> A. We will comply with the requirements of the Act and appropriate <br /> rules and regulations and with the amended Wagner-Peyser Act <br /> and appropriate rules and regulations. <br />
