He said the affordable units will be on the Hillsborough side of <br /> the project, closer to the houses. <br /> Craig Benedict said the amendments being requested to the resolution in Attachment 3 <br /> states the Applicant wishes to have a submittal by May 15, and an issuance prior to December <br /> 31, 2017. <br /> John Roberts said he has typed out the petitioner's request in the form of two new <br /> paragraphs at the end that he can read into the record, if the Board votes to adopt the <br /> changes requested by the Petitioner. <br /> Chair Dorosin said the Applicant made a petition, which the Board referred to staff. He <br /> said staff and the Petitioner have worked together in good faith, and in the interim, legislation <br /> was introduced that would eliminate the County from being able to collect impact fees. He said <br /> the Board's willingness to work with this issue existed in advance of the legislative bills being <br /> filed, and by no means is the Board acting with a gun to its head. <br /> Wayne Hadler said that Chair Dorosin sent a personal email to him after the February <br /> 21st meeting to let him know that his request had been referred to staff. <br /> John Roberts read the proposed amendments to the resolution: <br /> BE IT FURTHER RESOLVED THAT projects of 90-units in size or greater for which a Zoning <br /> Compliance Permit application has been has been submitted prior to May 15, 2017 and for <br /> which a building permit application has been submitted prior to January 31, 2019 may choose <br /> to pay either the public school impact fee that was in effect for 2016 for the housing type(s) <br /> proposed in the application or the fee required by the public school impact fee schedule in <br /> section 30-33 of Chapter 30, Article II of the Orange County Code of Ordinances, provided the <br /> fee is paid prior to June 30, 2020 and a Certificate of Compliance is issued prior to December <br /> 31, 2020. <br /> BE IT FURTHER RESOLVED THAT applicants for additional grandfathering of projects of 90- <br /> units in size or greater that submit a zoning compliance permit application prior to May 15, <br /> 2017 may submit requests and supporting information no later than July 31, 2017 to Orange <br /> County Planning Staff who, in conjunction with the Orange County Attorney, will prepare <br /> agenda items for Orange County Board of Commissioners consideration at the next available <br /> regular meeting of the Orange County Board of Commissioners. <br /> Wayne Hadler agreed to this amended language. <br /> John Roberts said the second paragraph is needed so that this is not seen as an <br /> individual benefit to one developer. <br /> A motion was made by Commissioner McKee, seconded by Commissioner Marcoplos <br /> to approve the amended resolution in Attachment 3 (deleting two paragraphs, and replacing <br /> them with two new paragraphs above). <br /> Chair Dorosin clarified that the motion contains that the ZCP must be submitted by May <br /> 15, 2017, and issued by December 31, 2017. <br /> John Roberts said the language says it has to be submitted by May 15, 2017, and a <br /> building permit application must be submitted by January 31, 2019, and does not address what <br /> Chair Dorosin just asked. <br />
