02 <br /> RESOLUTION <br /> AUTHORIZING ORANGE COUNTY TAX COLLECTOR TO <br /> DIRECT EXECUTION AGAINST PERSONAL PROPERTY <br /> TO THE SHERIFF <br /> WHEREAS, N.C. Gen. Stat. Section 105-366 of the Machinery Act <br /> authorizes the Tax Collector to proceed against personal property to enforce <br /> the collection of taxes; and <br /> WHEREAS, N.C. Gen. Stat. Section 105-367 of said Machinery <br /> Act, governing the procedure for levying against tangible personal propoerty <br /> to enforce the collection of taxes, requires authorization of the governing <br /> body if the Tax Collector desires to direct a levy and execution to the <br /> Sheriff; and <br /> WHEREAS, the Orange County Board of Commissioners by this <br /> resolution desires to authorize the Orange County Tax Collector to direct <br /> the levy and execution against personal property to the Sheriff on such <br /> occasions as the Tax Collector deems such procedures to be in the best <br /> interest of the County: <br /> 0 <br /> NOW, THEREFORE, BE IT RESOLVED that from and upon the <br /> date of this resolution, the Orange County Tax Collector be and he hereby <br /> 8 <br /> is authorized to direct the levy and execution against personal property to <br /> the Sheriff of Orange County as provided by N.C. Gen. Stat. Section 105- <br /> 367(b). <br /> Commissioner moved for the adoption of <br /> the foregoing resolution. Commissioner seconded the <br />
