-4- <br /> Article V: Permit to Exceed Maximum Permissible Standards <br /> ( 1) A person or group of persons intending to operate or cause <br /> to be operated a source of sound in excess of sound levels <br /> not requiring a permit as specified in Article II , must apply <br /> for a permit. <br /> (2) Any person or group of persons desiring a permit shall apply <br /> as provided herein and provide all information required. <br /> (a) The applicant must apply for a permit at least forty-eight (i <br /> hours prior to the activity for which the permit is requester <br /> (b) The Orange County Manager, or his designee, will act upon <br /> all requests for a permit, to exceed maximum permissible <br /> standards. <br /> (c) In considering and acting on all requests for permits pursuar <br /> to this article, the Manager shall consider, but shall not bE <br /> limited to the following in issuing or denying such permit: <br /> the timeliness of the application; the nature of the requestE <br /> activity; previous experience with the applicant; the nature <br /> of the event; the time of the event; other activities in the <br /> vicinity of the location proposed; the effect of the activity <br /> on surrounding areas; previous violations, if any, of the <br /> applicant. <br /> (d) Upon receipt of a permit to exceed maximum permissible sound <br /> levels, the applicant will pay to Orange County an administra <br /> tive fee of $5.00. <br /> (e) Permit holders agree to cooperate with the Orange County <br /> Sheriff's Department in enforcing this ordinance by having <br /> the applicant available at the site of the event during the <br /> entire time for which a permit has been issued and being <br /> capable of assisting the Sheriff in enforcing this Ordinance. <br /> Failure of the applicant to be present or to assist the <br /> Sheriff in complying with this ordinance will be cause for <br /> revocation of said permit. <br /> Article VI: Burden of Proof Regarding Exceptions <br /> In any proceeding based upon this ordinance, if an exception stated in <br /> this ordinance would limit obligation, limit liability, or eliminate either an <br /> obligation or liability, the person who would benefit from the application of the <br /> exception shall have the burden of proving that the exception applies and that <br /> the terms of the exception have been met. <br /> Article VII: Penalties <br /> (1) Civil Penalties <br /> (a) Any person violating any of the provisions of this ordinance <br /> shall be subject to a civil penalty of one hundred dollars <br />
