I am a resident of Orange County, Bingham <br /> Township. <br /> I wish to address the issue of the approach zone control. While <br /> 1 <br /> I agree with the staff's assessment that 5,000 feet should be under <br /> control of the applicant, there is ample evidence in the record to <br /> 1 <br /> support an amount necessary to control the height of natural growing <br /> fQ <br /> objects at reast 150 feet. More importantly, regardless of what <br /> number is eventually chosen, it is necessary that the zone be controlled, <br /> either by the applicant or the County. Without such control, there <br /> is no protectio1 n for the applicant or others concerning adjacent land <br /> uses . <br /> In implemehting this ordinance the County recognized the fact <br /> that airports would have impacts beyond site boundaries. The County <br /> adopted the special use permit process to evaluate proposals having <br /> wide ranging effects and thus a special use permit is required of <br /> any proposed airport within the County 's zoning jurisdiction. Rather <br /> 1 <br /> than creating an airport district and control surrounding area thru <br /> 1 <br /> zoning or develop a publicly owned facility and control surrounding <br /> area by the use of eminent domain, the County chose to place the <br /> burden of minimizing conflicting adjacent land uses on the applicant. <br /> 1 <br /> Thus, as a requirement separate and apart from any FAA, State or other <br /> federal regulation, the Orange County zoning ordinance requires <br /> "that land sufficient to provide approach zones and over- <br /> run areas is owned or controlled by the applicant. " <br /> To date, Orange County has not amended its ordinance to eliminate <br /> this requirement of any developer of a proposed airport within the <br /> County's zoning jurisdiction nor has the County shown any interest in <br />
