i <br /> Motion to Assess Civil Penalty On <br /> Owner of Wild Animal Who <br /> Is Violating County Ordinance <br /> Motion that: <br /> Whereas, "An Ordinance Regulating The Keeping of Wild Animals Dangerous to <br /> i <br /> Persons and Property Within Orange County", Section 6 . Enforcement, Pen- <br /> alties Numjer (2) Civil Penalty, page 10 authorizes the Commissioners to <br /> make or cause to be made a written demand for payment of a penalty by any <br /> person who violates this ordinance ; that such penalty shall be $50,00 per <br /> animal per ay; and, that the violator(s ) have been notified of the exis- <br /> tence and n ture of the violation by certified letter; that, <br /> Therefore, the Commissioners find that since Mr. Charles Younger did promptly <br /> remove his snakes upon receipt of notification of violation of the Ordinance <br /> by certified letter, that he not be subject to civil penalty; that, <br /> However, Mr. Taylor M, Greene III of 208 Green Street , Chapel Hill, continues <br /> to violate the ordinance by keeping wild animals without a permit in <br /> Orange County after notification by certified letter of this violation on <br /> May 7 ; that, <br /> Accordingly, Mr. Greene be assessed the stipulated penalty for keeping as many <br /> as 8 wild animals from May 7 to May 16 (at a potential penalty of $50 X 8 <br /> animals X 8 days or $3,200) and that he be additionally penalized, for <br /> keeping as many as 6 wild animals from May 16 until such time as all his <br /> wild animals are removed from Orange County; that the exact daily count <br /> and daily penalty be calculated by the County Manager based upon a deter- <br /> mination of he number animals actually kept by Mr. Greene ; that the <br /> Manager perpare a written demand for payment which sets forth in detail <br /> a description of the violation for which the penalty has been imposed and <br /> the exact penalty assessed; and, that the Manager cause this written de- <br /> mand to be served upon Mr. Greene , <br />
