. , , 3 ' Or, d 01 a.,,/ 6 <br /> TO: The Board of County Commissioners of Orange County <br /> FROM: The Animal Protection Society of Orange County, Inc. <br /> RE: Appointment of an Animal Cruelty Investigator for Orange County <br /> March 16, I 1981 <br /> The oard of Directors of the Animal Protection Society of Orange <br /> County, Inc. respectfully requests that the Board of County Commissioners <br /> implementtthe provisions of the General Statutes as amended by the <br /> 1979 session of the General Assembly providing for the appointment of <br /> county Animal Cruelty Investogators and for the execution of an agreement <br /> between a bounty and a, local humane society incorporated under North <br /> Carolina Ilaw relating to the nomination and expenses of said Investigator. <br /> Background: Reports of cruelty and neglect of animals in Orange County. <br /> both household pets and farm animals, are frequently received by the <br /> Director of the County Animal Shelter and by Animal Control Officers.. <br /> These persons have other duties to perform which take priority over <br /> the time-cpnsuming investigation of cruelty reports; the Director of <br /> the Shelter lacks official status to pursue legal recourse. <br /> At the urging of the North Carolina Humane Federation the 1979 session <br /> of the General Assembly enacted statues providing for the appointment <br /> of county Cruelty Investigators. The text of the law is attached. The <br /> position is envisioned as a part-time official appointment and the <br /> Investigator is to receive no compensation or employee benefits from <br /> the county but the county may reimburse him for necessary and actual <br /> expenses such as automobile mileage. The Investigator is to wear a <br /> badge of a design approved by the Commissioners, but provided at no <br /> cost to the county. The Investigator is required to take an oath, but <br /> not required to post bond. The investigator is authorized to file <br /> r complaintslwitli a magistrate and to serve a magistrate's order to <br /> seize animals, but to make forcible entry into property only by <br /> day and only when accompanied by a law enforcement officer. He is not <br /> ' required to pay any costs or fees prior to final judicial determination. <br /> Interference with the Investigator in the performance of his duties is <br /> a misdemeanor, punishable by a fine up to $200. The Investigator is <br /> required to attend a course of instruction of at least six hours offered <br /> by the North Carolina Humane Federation at no cost to the county. <br /> Terms of APS Offer: I.n order to implement the provisions of the law <br /> the Animal Protection Society of Orange County, Inc. is prepared to <br /> provide the following services and support: <br /> - preparation of a job description; <br /> - nomination of a candidate; <br /> - payment of a retainer of $200. a month for a probationary <br /> period of 3 months, to be extended for an additional 9 <br /> months if satisfactory to all parties; <br /> - payment of expenses incident to the required 6 hour course <br /> of instruction; <br /> - provision of film and use of a camera for investigations; <br /> - P=ovision::of record books and report form; <br /> - use of APS equipment and facilities as needed. <br />
