27 <br /> 1 • The Board was unaware of the existence of the Board of Health bylaws that prohibit the <br /> 2 appointment of former health department employees to the Board of Health; <br /> 3 • The Board acknowledges that the bylaws are not binding upon the Board's appointment <br /> 4 process; <br /> 5 • The Board, however, desires to remain in compliance with the bylaws to avoid any <br /> 6 unnecessary conflicts among Board of Health members or between Board of Health <br /> 7 members and the health department and its employees; <br /> 8 • Dr. Barber has not taken the oath of office associated with membership on the Board of <br /> 9 Health or assumed any duties related to such membership and has therefore not <br /> 10 officially been appointed to that Board; <br /> 11 • For these reasons the original appointment of Dr. Barber to the Board of Health is <br /> 12 rescinded. <br /> 13 <br /> 14 Commissioner Jacobs apologized to Dr. Barber, and said he feels the bylaws are <br /> 15 misguided, and if one has served in the health department that it should not preclude one from <br /> 16 serving on the BOH. <br /> 17 Commissioner Price said she disagreed with the bylaws. <br /> 18 <br /> 19 VOTE: Ayes, 4 (Commissioner Burroughs, Commissioner Rich, Commissioner Jacobs, <br /> 20 Commissioner Marcoplos); Nays, 3 (Commissioner Dorosin, Commissioner Price, <br /> 21 Commissioner McKee) <br /> 22 <br /> 23 A motion was made by Commissioner Burroughs, seconded by Commissioner <br /> 24 Marcoplos to appoint Johanna Birckmayer to position 8. <br /> 25 <br /> 26 Commissioner McKee said he will not be able to vote for this appointment in order to <br /> 27 stay consistent with his beliefs that the original appointment should stand. He said, however, <br /> 28 his vote against this motion has no bearing on Dr. Birkmayer's qualifications or fitness to serve. <br /> 29 Commissioner Price echoed Commissioner McKee's comments. <br /> 30 <br /> 31 VOTE: Ayes, 4 (Commissioner Burroughs, Commissioner Jacobs, Commissioner Rich, <br /> 32 Commissioner Marcoplos); Nays, 3 (Chair Dorosin, Commissioner McKee, Commissioner <br /> 33 Price) <br /> 34 <br /> 35 12. Closed Session <br /> 45 <br /> 46 A motion was made by Commissioner Rich, seconded by Commissioner Marcoplos to <br /> 47 go into closed session at 10:10 p.m. for the purpose below: <br /> 48 <br /> 49 "Pursuant to G.S. § 143-318.11(a)(3) "to consult with an attorney retained by the Board in order <br /> 50 to preserve the attorney-client privilege between the attorney and the Board." <br />
