2. Obligations of the Recipient The recipient shall perform the <br /> program as specified in the application approved by NRCD, The recipient <br /> shall co'jmply with the certifications pursuant to Paragraph (j) of Rule <br /> .0407 of the North Carolina Community Development Block Grant <br /> Administirative Rules , 15 NCAC 13L .0407(j) . The recipient shall also <br /> comply with all other lawful requirements of NRCD, all applicable <br /> requirements of the General Statutes of the State of North Carolina and <br /> any other applicable laws and Executive Orders currently or hereafter in <br /> force . <br /> 3. I Obligations of Recipient with Respect to Certain Third Party <br /> Relationships . NRCD shall hold the recipient responsible for complying <br /> with th provisions of this agreement even when the recipient designates a <br /> third party or parties to undertake all or any part of the program. The <br /> recipie t shall comply with all lawful requirements of NRCD necessary to <br /> insure hat the program is carried out in accordance with the recipient's <br /> certifi ations including the certification of assumption of environmental <br /> responsibilities under Rule . 1004 of the North Carolina Community <br /> Development Block Grant. Administrative Rules, 15 NCAC 13L .1004. <br /> 4, Interest of Members, Officers,_ or Employees of the Recipient, <br /> Members of Local Governing Body, or Other Public Officials. No member, <br /> officer, or employee of the recipient, or its agents, no member of the <br /> governing body of the locality in which the program is situated, and no <br /> other public official of such locality or localities who exercises any <br /> functions or responsibilities with respect to the program during his <br /> tenure or for one year thereafter, shall have any financial interest, are <br /> direct r indirect, in any contract or subcontract, or the proceeds <br /> thereof, for work to he performed in connection with the program assisted <br /> under this agreement. Immediate family members of said members, officers, <br /> employes, and officials are similarly barred from having any financial <br /> interest in the program. The recipient shall incorporate, or cause to be <br /> incorporated , in all such contracts or subcontracts, a provision <br /> prohibiting such interest pursuant to the purpose of this section <br /> ThJ assistance provided under this agreement shall not be used in the <br /> • paymentlof anyt .bonus or commission for the purpose of obtaining NRCD <br /> approval1 of the application for such assistance, or NRCD approval of <br /> applications for additional assistance, or any other approval or <br /> concurrence of NRCD required under this agreement, or the North Carolina <br /> Community Development. Block Grant Administrative Rules , with respect <br /> thereto; provided, however, that reasonable fees or bona fide technical, <br /> consult nt, managerial or other such services, other than actual <br /> solicitation, are not hereby prohibited if otherwise eligible as program <br /> costs- <br /> 5. Reimbursement to NRCD for Improper Expenditures: The <br /> recipient will reimburse NRCD for any amount of grant assistance <br /> improperly expended. <br /> 2 <br />
