AGREEMENT BETWEEN THE ORANGE-PERSON-CHATHAM MENTAL HEALTH, MENTAL RETARDATION, <br /> SUBSTANCE ABUSE AUTHORITY and ORANGE COUNTY GOVERNMENT FOR RENOVATION OF REAL <br /> PROPERTY <br /> This agreement is entered "into between the Orange-Person-Chatham Mental Health <br /> Mental Retardation, and Substance Abuse Authority (hereinafter referred to as <br /> 'Authority") , and Orange County (hereinafter referred to as "County") . The purpose <br /> of this agreement is to enable the Authority to receive funds from the State of <br /> North Carolina through the Department of Human Resources, Division of Mental Health, <br /> Mental Retardation, and Substance Abuse Services for allocation to the County for <br /> the renovation of real property. <br /> The parties hereto, acting through their authorized officials, do hereby agree as <br /> follows: <br /> A. That the Authority: <br /> 1. Shall make written application to the North Central Regional Office of the <br /> Division of Mental Health, Mental. Retardation, and Substance Abuse Services <br /> in Winston-Salem, North Carolina, for a grant in accordance with the North <br /> Carolina Administrative Code, <br /> 2. Shall comply with provision of N.C. G.S. 143-129 and any other appropriate <br /> statutory requirements for purchasing. <br /> 3. Shall obtain written verification from the Division of Facility Services that <br /> an existing facility can, with specified modifications, comply with licensure <br /> requirements. <br /> 4. Shall obtain written verification from the Division of Facility Services <br /> that architectural plans for new construction shall comply with licensure <br /> requirements. <br /> 5. Shall obtain written verification from the appropriate local governmental <br /> authority that the location meets all zoning requirements. <br /> 6. Shall abide by the applicable rules, regulations, guidelines, and statutes <br /> of the Division of Mental Health, ,Mental Retardation, and Substance Abuse <br /> Services, Department of Human Resources, State of North Carolina, and the <br /> United States. <br /> 7. Shall be responsible for maintenance and upkeep of the property, <br /> 8. Shall allow inspection of the property by the County, Department of Human <br /> Resources employees, or any other agency having licensure responsibilities <br /> for the facility to review and inspect as deemed appropriate by that agency <br /> director or his designee. <br /> • <br />
