Tryon Street <br /> Hillsborough, North Carolina 27278 <br /> Dear Mark: <br /> You requested us to research the insurance aspects of the fire and burglar <br /> alarm monitoring services. <br /> We will research whether that would be covered or not with Great American. <br /> If not, I am researching cost from another source, if available at all. <br /> In the meantime, we had some other possible recommendations for your con- <br /> sideration. <br /> It appears to us that the County is taking on responsibilities for some <br /> events that I may not be under their control. For example, we could have <br /> a malfunction with the burglar alarm system or a possible malfunction <br /> with the telephone system which would prevent your properly responding <br /> to an emergency call. Since you are not making a charge for this service, <br /> we feel that perhaps a hold harmless agreement from the protective service <br /> company would be a possible risk management technique in the interim. <br /> This hold harmless agreement would defend and hold the County harmless <br /> from any lawsuits arising out. of this service; thereby, transferring the <br /> risk to the vendors. You probably coup. seek the advice of the County <br /> attorney in structuring such a hold harmless agreement. <br /> In our disc the other day, we both felt there might be a lot of <br /> political consequences because of your failure to respond to a call. <br /> This could n ossibly have repercussions all, the way to the County <br /> Commissioner level. Since the County has no control over potential <br /> malfunctions arising out of the actual burglar alarm system as well as <br /> all the eledtrical connections to the 911 center, we felt the County was <br /> taking on a lot of responsibility without collecting any revenues for <br /> this service. <br /> 1 <br />
