'042 <br /> , (3) That I an animal or:animals cannot or will not be kept or main- <br /> tained without endangering the safety of any person or property; <br /> and/or <br /> . <br /> (4) When the animal is will not, or cannot be maintained in a humane <br /> mann r. <br /> In the event that the Director revokes said permit, the permittee shall <br /> be entitled to a hearing before the Board by requesting same within five (5) <br /> days of receipt of notice of revocation. The decision of the Board after <br /> heating and the reasons therefore shall be sent by certified mail. or hand <br /> delivered to pe'rmittee and shall constitute a final administrative decision. <br /> I . <br /> Transfer d.f Permit - The permit shall not be transferrable with respect <br /> to persons and/or locations. <br /> Section 4. Exemptions. <br /> The provisions of this Ordinance shall not apply to the keeping of wild <br /> animals in the following case, provided, all such facilities are in compliance <br /> with applicable federal, state or local rules and regulations; <br /> Animals us d for teaching and/or research purposes at the University <br /> of North C <br /> II <br /> rolina at Chapel Hill. <br /> Section 5. Wild Animals At Lane, Prohibited <br /> It shall be unlawful for any wild animal.to be off the premises approved <br /> for confinement of the animal or off the premises where it is kept and maintained <br /> without written permission of the Director. It shall be the duty of the permittee <br /> or the person w o keeps and/or maintains the animal to care for the animal at all <br /> times and miaint in confinement as provided in the enclosure standards contained <br /> in Appendix A. RESERVED) When any wild animal is found off the premises approved <br /> for confinement or off the premises where it it kept and maintained without written <br /> permission of tb,e Director, the permittee or keeper may be charged with a criminal <br /> act. If convicted of a violation of this provision the Court may order the animal <br /> to be euthanized or the permittee or keeper subjected to penalties as provided in <br /> Section 6 of this Ordinance or both euthanization and such penalties. <br /> It shall be the duty of any permittee or keeper of a wild animal to immedi- <br /> ately report toithe Orange County Sheriff's Department when the animal is dis- <br /> covered missing <br /> Any person who willfully, negligently or in violation of the provisions of <br /> this Ordinance eepsand/or maintains a wild animal shall be liable for any expenses <br /> incurred in searching for, containing, returning or disposing of the animal when it <br /> is off the premises of the permittee and/or keeper. <br /> Section-6. Enforcement <br /> Any owner keeping or harboring a wild animal at the date of the adoption of <br /> this Ordinance shall comply with the application and permit provisions herein <br /> within thirty (30) days of the adoption of this Ordinance, and shall meet the <br /> primary and secondary enclosure standards within one hundred and twenty (120)days <br /> of their adoption . <br /> Inspections <br /> The Orange , ounty Health Department, the Oranee County Inseectinnc n4lTior,,, <br />
