1 <br /> 1 <br /> 039 <br /> AN ODINANCE REGULATING THE KEEPING OF WILD ANIMALS <br /> I WITHIN ORANGE COUNTY <br /> I <br /> WHEREAS, the Board of Commissioners is concerned for the safety and welfare <br /> of all of the citizens of Orange County as well as the safety and welfare of <br /> wild animals, and desires to enact an ordinance regulating the keeping of <br /> wild animals in Orange County pursuant to Article 6 of Chapter 153A of the <br /> General Statutes of North Carolina: <br /> NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF <br /> ORANGE COUNTY as follows: <br /> Section 1. Definitions: As used hereinafter, the following terms <br /> shah, mean: <br /> Director:ector: The Director of the Orange County Health Department. <br /> Board: The Board of County Commissioners of Orange County. <br /> Wild Animas Dan;,erous to Persons and..Pro:ert• hereinafter referred <br /> to as 'Wild Animals : The term applies to species of animals not considered <br /> domestic,—specifically, all felines (other than the domestic house cat), <br /> nonhuman primates, bears, wolves, coyotes, reptiles (poisonous, crushing <br /> and giant), and any crossbreed of such animals which have similar character- <br /> istics of the a imals specified herein. In order to properly administer the <br /> provisions of tis Ordinance, the Board may add to or remove from the classi- <br /> fication of wild animal any bird, mammal, reptile, aquatic and amphibious forms, <br /> or other members of the animal kingdom. Addition& to or deletions from the <br /> list may be mad only if the Board determines, after receiving evidence, that <br /> such species because of habit, mode of life or natural instinct is incapable of <br /> being domesticated, requires the exercise of art, force or skill to keep them <br /> safely in subje tion, and would create a reasonable likelihood of hazard to the <br /> public. Each determination by the Board as to additions or deletions shall <br /> become effective I upon approval. <br /> 1 <br /> Owner: Any person, firm, or corporation who keeps, has charge of, shelters, <br /> feeds, harbors, or takes care of any wild animal in Orange County. <br /> Permittee: Any individual or corporation who has been granted a permit <br /> to keep, 7helter, feed, harbor, or take care of any wild animal in Orange County. <br /> Primary Enclosure: Any metal building, wire cage, paddock, pen or <br /> similar enclosure designed and used for the purpose of restraining and <br /> confining any wild animal, the keeping of which is regulated by this <br /> Ordinance. All such enclosures shall be constructed'and maintained accord- <br /> ing to the standards set out in Appendix A of this Ordinance entitled <br /> "Standards for Primary and Secondary Enclosures of Wild Animals". (RESERVED) <br /> Secondary Enclosure: Any enclosure which is not used for the primary con- <br /> finement,. exercise or training of wild animals. Each person, firm, or corporation <br /> keeping any wild animal shall construct and maintain continuously a secondary <br /> enclosure encompassing the complex of primary enclosures where such animals are <br /> kept. This secondary enclosure will be constructed and maintained according to <br /> the standards specified in Appendix A (RESERVED) and depending on the animals <br /> kept. <br /> Section 2. Primary and Seconds Enclosure Required. <br /> I <br />
