Ward, Director <br /> Orange County Department of Social Services <br /> 300 West Tryon Street <br /> Hillsborouigh, North Carolina 27278 <br /> Dear Mr. Ward: <br /> We have coisidered the information presented in the November 19th hearing <br /> at which Orange County appealed the originally proposed resolution of the <br /> Dot audit for the FY 1980-81. We have also sought clarification of <br /> certain federal regulations that bear on the situation, in the hope that <br /> we might thereby be enabled to offer an avenue of relief. The Division <br /> has given particular consideration to the undeniable benefit imparted to <br /> social services programs as a 'result of the county DSS's occupancy of the <br /> Tryon Street building during the 1980-81 fiscal year. <br /> As a res lt, the Division is now prepared to permit Orange County to <br /> amend their current indirect cost plan to allow for the inclusion of 1980- <br /> 81 actual occupancy costs. This revised position is predicated, however, <br /> on the coalition that the county seek reliable and expert advice in making <br /> a realistic determination of the comparable rental rates (in the same <br /> locality) applicable to the 1980-81 fiscal year, and that the county <br /> evidence tite results of this effort by forwarding at least three such <br /> comparable rental statements to the Division Controller. <br /> The county is cautioned that this dispensation does not extend to the <br /> disallowed cost of space ($5,935) that was included in the county's <br /> 1980-81 plan (the circumstances were different), nor does it alter the <br /> Division's requirement that prior approval and/or comparable rental rates <br /> be established before the reporting of occupancy costs. <br /> I am pleased that the Division may now avoid having to penalize the county <br /> for a sit4tion in which they may not be entirely at fault.
