i <br /> NORTH CAROLINA j Olt <br /> ORANGE COUNTY I <br /> LEASE AGREEMENT <br /> THIS LEASE AGREEMENT is made and entered into this day of <br /> by an (hereinafter,between the Town of Carrboro, lessor (hereinar, "The Town") <br /> and Orange County, lessee (hereinafter, "The County") , <br /> WHEREAS, The County wishes to lease space within the Carrboro Town Hall <br /> from The Town and make this space available to the State of North Carolina for the <br /> operation of a divers' license examination office; and <br /> WHEREAS, The Town has available excess space within the Town Hall and <br /> is willing to lease this space under the terms of this agreement so that a drivers' <br /> license examination office can be made conveniently available to town residents; <br /> NOW, THEREFORE, in consideration of the premises and the mutual cove- <br /> nants and conditions set forth below, the parties to this agreement hereby agree <br /> as follows: <br /> 1. Leased Premises. The Town hereby leases to The County and The <br /> County hereby leases from Town a portion of the lowest level of the Town Hall <br /> behind the recreation department, which space comprises approximately A-00 square <br /> feet as shown on the diagram attached hereto as Attachment A and incorporated herein. <br /> However, The Town reserves the right of access to and through the hallway immediately <br /> bordering the entrance door to the office space. <br /> 2. UJe of Leased Premises. The space described in paragraph one is <br /> leased to The County so that The County may make the space available to the State <br /> of North Carolin for use as a drivers' license examination office. If the <br /> drivers' license examination office fails to locate in the leased premises or <br /> vacates the premises during the lease period, then this lease may be terminated by <br /> The Town. <br /> 3. U e of Parkin• Sfaces and Other Facilities. Lease of the above <br /> described premises carries with it, both on t e part of the drivers' license ex- <br /> aminers and the iublic who will make use of this office, the right to reasonable <br /> access through the Town Hall parking lot (the drivers' license examiners shall park <br /> their personal vehicles in the small parking area adjoining him Street and the rear <br /> of the ballfield) and the right to use other common facilities including restroom <br /> facilities. <br /> 4. Rent/Improvements. As consideration for The Town entering into <br /> this lease, TheCounty shall improve and renovate the leased premises in accor- <br /> dance with the work description shown on Attachment A. All work shall be done <br /> subject to The Town's approval by employees or agents of The County and at The <br /> County's expense) Both parties agree that the reasonable value of the improve- <br /> ments to be made as shown on Attachment A is $8,100. In addition, The County <br /> shall pay to The Town monthly, by the 10th of each month, the sum.: of $75.00 <br /> to cover the cost of all utilities provided to the premises (other than tele- <br /> phone service, 14ich shall be paid for separately by the occupant of the leased <br /> premises) and custodial services. The County shall also reimburse The Town <br /> for the cost of placing sufficient signs on the Town Hall premises to direct <br /> persons to the drivers' license examination office. <br /> 5.
