A-2903 <br /> NEW CONSTRUCTION, SUBSTANTIAL REHABILITATION, <br /> MODERATE REHABILITATION AND EXISTING HOUSING <br /> 1 <br /> This section 8 Annual Contributions Contract (ACC) is between the United States of <br /> America, acting thr ugh the Department of Housing and Urban Development (HUD), under the <br /> United States Housin Act of 1937, 42 U.S.C. 1437, et seq. (Act), and the Department of HUD <br /> Act, 42 U.S.C. 3531' and Orange Count Housin• Authorit <br /> (PHA), which is a"public housing agency" as defined in the Act. T e parties agree as follows: <br /> 0.1 PROJECT OR PROJECTS. The PHA is undertaking to provide decent,safe, and sanitary <br /> housing for Eli ible Families pursuant to section 8 of the Act by means of Housing <br /> Assistance Payments Contracts (Contracts) with Owners. This may involve agreement <br /> for the use of housing to be constructed (New Construction), agreement for the use of <br /> existing housin to be substantially rehabilitated (Substantial Rehabilitation), agreement <br /> for the use of existing housing to be moderately rehabilitated (Moderate Rehabilitation), <br /> or the use of existing housing without substantial or moderate rehabilitation (Existing <br /> Housing). In each instance,the numbers and sizes of dwelling units with respect to which <br /> a certain maxir~lum annual contributions commitment is made shall constitute a project <br /> under this ACC and shall be identified by a project number. <br /> 0.2 PART I, PART II AND PART III OF THIS ANNUAL CONTRIBUTIONS CONTRACT. <br /> (a) Certain provisions of this ACC, principally those which are specifically applicable <br /> to a designated project, are contained in Part I. Separate forms of Part I apply to <br /> different types of projects (i.e., New Construction and Substantial Rehabilitation <br /> (HUD-52520D), Moderate Rehabilitation (HUD-525209 (SUPP)) and Existing <br /> Housing ( IUD-52520B)). A separate Part I, on the applicable form, has been <br /> executed with respect to each project. Each Part I is a part of this ACC. <br /> (b) Part II and Part III contain the remaining provisions of this ACC and are not <br /> executed separately. Part II (HUD52520C (SUPP), dated 12/79 _ ) <br /> is used fok' Existing Housing and Moderate Rehabilitation. Part III (HUD-52520E, <br /> dated 1 8/80 ) is used for New Construction and Substantial <br /> Rehabilitation. <br /> (c) This ACC consists of the Master, appropriate Parts I, and Parts II and/or III, as <br /> applicable. <br /> 0.3 FISCAL YEAR. Except for the first fiscal year of each project, there shall be one fiscal <br /> year for all projects under this ACC.. This fiscal year shall be the 12-month period <br /> ending Decembdr 31 of each calendar year. The first fiscal year for each <br /> project shall be s provided in the Part I applicable to the project. <br /> 0.4 COMPLIANCE ITH ACT REGULATIONS AND OTHER RE•UIREMENTS. <br /> The PHA agrees to comply, and to require Owners to comply, with the U. S. Housing Act <br /> of 1937 and all pplicable regulations and requirements. <br /> 0.5 SCHEDULE O PROJECTS. Attached to this ACC, as Attachment A, is a list <br /> identifying each ACC Part 1 and ACC Part I amendment by project number, date, and <br /> ACC/HAP Contract List number and date. <br /> 0.6 PREVIOUS MASTER ACCS SUPERSEDED.
