Additional animals or classes of animals <br /> may be auth rized by amended permit, which shall be applied for and issued <br /> in the same manner as an original permit. <br /> Investa.gationDirector - Each application for permit or amendment <br /> shall be fil1ed with the Director who shall inspect all locations for the <br /> keeping of any wild or dangerous animal for cleanliness and safe possession <br /> of the animal. <br /> Prior io the granting of a permit or amendment the applicant shall be <br /> required to present to the Director, for his inspection, a State of North <br /> Carolina Wildlife Resources Permit, if the keeping of such animal in this <br /> state requiies any such permit. <br /> Such permit or amendment shall be issued by the Director after satis4, <br /> factory evidence by the applicant and personal inspection by the Director <br /> that the applicant will confine any wild or dangerous animal in facilities <br /> that meet t e standards contained in Appendix A. <br /> Such p rmit or amendment will not be issued by the Director when he <br /> finds one or more of the following: <br /> Cl) Nc permit or amendment shall be issued when any outdoor <br /> enclosure designed for confinement Of a wild or dangerous <br /> animal is located closer than 100 feet from any property <br /> line; <br /> (2) Intentional misstatements or misleading statements of fact <br /> in the application; <br /> (3) An applicant who has previously had his wild or dangerous <br /> - animal permit revoked; <br /> (4) Wien, in the Director's opinion, the animal cannot or will. <br /> not be kept or maintained without menacing the safety of any <br /> p rson or property; <br /> (5) 4en, in the Director's opinion, the animal is, will, or <br /> cannot be maintained in a humane manner. <br /> Each 4plicant shall be notified by certified mail of the issuance <br /> or denial of a permit or permit amendment by the Director. <br /> If the Director does not issue a permit or amendment, the reasons for <br /> his not doi. g so shall be in writing and shall accompany the notice of denial. <br /> An applicant may request a hearing before the Director by written request <br /> within five (5) days after receipt of notice of denial of a permit or permit <br /> amendment. The Director shall render a decision including findings of fact <br /> based on th evidence presented at such bearing. In the event that the Director <br /> denies saidlpermit, the permittee shall be entitled to a hearing before the <br />
