Margaret Lane <br /> Hillsborough N.C. 27278 <br /> Dear Mr. Polatty: <br /> It is our uny.erstanda.ng that Orange County intends to require <br /> developers of privately owned airports in the County to own <br /> or control all of the land lying under the FAA-defined "approach <br /> zone" . We believe that such a requirement is unreasonable. and <br /> . * unfair to thle private citizen who is using his own funds to . <br /> provide vita air transportation access for the County. <br /> We are partiCular1y concerned that the County may be going far <br /> beyond FAA standards in its requirements for private airports. <br /> As Bruce Matthews pointed out in his letter of ,Tune 28 , FAA <br /> requires ownership or control of only the clear zone. Any <br /> controls beyond the clear zone normally takes the form of a <br /> height restriction zoning ordinance. Such an ordinance is <br /> clearly beyond the ability of a private citizen and should be <br /> a County responsibility. <br /> We recognize that Orange County shares our goals of the maximum <br /> possible op4rational safety for North Carolina' s airports, both <br /> public and rivate. We encourage the County to develop a <br /> cooperative program• with private airport owners to ensure safe- _ <br /> facilities. i Such a program would require the owner' s control zone while a county zoning ordin <br /> of land underlying the cleat ordinance <br /> would ` provide protection against hazardous objects being erected <br /> or allowed ;o grow beyond the clear zone. . <br /> wn recognize the need for counties to develop and maintain ' <br />
