THIBAUT
September 15, 1982
Emmett Chee and Mary Sue M. Cheek
Route 1
Chapel Rill, N.C. -
Dear Mr. and Ms. Cheek:
We represent the developers of Midway Airport, which has been
approved for a Special Use Permit by the Orange County Board of
Commissioners provided Certain conditions are met. One of the
conditions hich we are to endeavor to meet is to obtain air right
easements olver certain property located to the north and to the
south of the runway location. Enclosed for your reference please
find a copy of a composite tax map, showing the nearest end of the
runway and the overlap of the approach zone area with reference to
your parcel of property. Also enclosed is a sample form for the
Approach tope Easement, which we believe would meet the requirements
of the Special Use Permit conditions, and which would basically
restrict the height of objects built upon the ground within the
approach-zoe area, at a slope of 20 to 1 from the end of the runway
until a distance 5,000 feet away. As you look at the diagram, bear
in mind that an object 1,000 feet into the approach zone could be no
higher than 50 feet, an object 2,000 feet into the approach zone
could be no higher than 100 feet, an object 3,000 feet into the
approach zone could be no higher than 150 feet, an object 4,000 feet
into the approach zone could be no higher than 200 feet, and an
object a full 5,000 feet from the runway could be no higher than 250
feet. The easement would restrict the building of any structures to
those height limitations, and would allow us to top any trees which
would grow to a sufficient height to penetrate this imaginary slope
surface as indicated by the diagram.
Plea a contact our office as soon as possible and advise us
simply as to whether you would be willing or unwilling to sign such
an ApproachIEone Easement, along the general lines of the sample
contained w th this package. Your attention to this request would
be greatly appreciated, indicating your desires in this regard.
-
Sincerely, -
1 .. r AI ..
