831 148 <br /> 84.5 Presentation Of Evidence At Public Hearings <br /> The Chairperson of the Board shall administer oaths to any <br /> • <br /> witness wishing to present evidence, testimony or exhibits <br /> concerning the Special Use Permit aoplication. <br /> 8.4.6 Planning Board' Action on Class A Soecial Uses, <br /> The Planning Board, within thirty (30) days of the public <br /> hearing shall prepare and submit to the Board of Commissioners <br /> a recommendation concerning the disposition of the application. <br /> Failure of the Planning Board to submit a recommendation within <br /> the required time shall be considered a favorable recommendation, <br /> without conditions. <br /> 8.4.7 Action On The Application <br /> After completion of the public hearing, the Board of County <br /> Commissioners or the Board of Adjusnent, as appropriate, shall <br /> take action upon the application. This action shall be one of <br /> the following: <br /> a) Approval; <br /> b) Approval with conditions attached; • <br /> c) Denial. <br /> In every case, the action of the Board shall include a summary <br /> of the evidence supporting the action taken by it on the application. <br /> 8.4.8 Imposed Conditions. <br /> The Board of County Commissioners or the Board of Adjustment, as <br /> appropriate, may impose such reasonable conditions upon approval <br /> of a Special Use as will afford protection of the public health, <br /> • <br /> safety and general welfare, ensure that substantial justice is <br /> done and equitable treatment orovided. <br /> Such conditions shall run with the land and use, and shall be <br /> binding on the original applicant (s) as well as all successors, <br /> assigns and heirs. <br />
