` ' <br /> 094 <br /> D-9. RETAINAGE FEE REDUCTION REQUEST <br /> The Manager told the Board that Security Building Company had requested <br /> a reduction of their retainage fee from 70% to 5%. Their request is based on <br /> the fact that the County has occupied Phase I with no major defects yet remaining <br /> to be corrected and that Phase II will be completed within 60-90 days. <br /> The Board expressed a concensus that Security Builders had not made a case <br /> for hardship and that it preferred to leave the retainage at 10% at this time <br /> until completion. The Board said it would entertain a request for retainage <br /> reduction based on hardship if Security wished to pursue the question, <br /> D-7l. LAND RECORDS PROGRAM ORDINANCE <br /> O-l2, REAL ESTATE SALES VALUE DISCLOSURE STATEMENT <br /> Mr, Roscoe Reeve, Land Records Manager, and Mr. Kermit Lloyd, Tax Supervisor, <br /> presented and summarized both ordinances for the Board. Mr. Reeve said that the <br /> Land Records Program Ordinance would provide an accurate index by parcel number <br /> and enhance the integrity and accuracy of the County's Land Records. <br /> Mr. Reeve added that with regard to the Land Sales Ordinance it would aid <br /> the integrity of the records since the person recording would attest to the value <br /> of the conveyance and additionally, it provides groundwork for valuation of the <br /> property in the County. <br /> Commissioner-elect Lloyd asked if the realtors had been contacted regarding <br /> . their opinions of the proposed sales value disclosure ordinance; he feels that an <br /> . "outcry" would ensue if this ordinance is adopted. Tax Supervisor Lloyd said <br /> . the local Bar Association had been contacted since they are the ones who record <br /> , the deeds. He said the response had been that it might entail extra work for them <br /> " and that they might incur liability if they recorded a disclosure statement that <br /> • was later deemed in error. Tax Supervisor Lloyd said that was the reason for <br /> , insertion of "willful" to the ordinance. <br /> , Mr. Bob Windsor, a reporter, said that being in the real estate field, his <br /> , feeling was that it was an invasion of privacy; that it was no business of the <br /> , County what people paid for their property. <br /> Commissioner Gustaveson moved, seconded by Commissioner Nillhoit, to adopt <br /> , the Land Records Program Ordinance with the efFective date of January 1 , 1983. <br /> Vote: Ayes, 5; Noes, O. <br /> ', Commissioner Walker moved to table the Sales Disclosure Ordinance, Motion <br /> ' died for lack of a second. <br /> \, <br /> '~ <br /> ), <br />
