The penalty for each violation shall be ten <br /> 12 dollars ($ 0.00) per day per resident affected by the violation. <br /> 13 (c) Any facility wishing to contest a penalty shall t- ' <br /> 14 entitled to\ an administrative hearing as provided in th., <br /> 1 <br /> 15 Administrative Procedure Act. <br /> 1 <br /> 16 (d) The ecretary of Roman Resources may bring a civil action <br /> 17 in the Superior r Court of Wake County to recover the amount of the <br /> 1 <br /> le administrative penalty whenever a facility: <br /> 1 <br /> 19 (1) 1 Which has not requested an administrative hearing <br /> 20 fails to pay the penalty within 60 days after being <br /> __ _21 - otified of such penalty, or <br /> 22 (2) !hich has requested an administrative hearing fails <br /> 23 to pay the penalty within 60 days after service of <br /> a a written copy of the decision as provided in G.S. <br /> 25 - ' 1\50A-36. <br /> ),...- <br /> 131C-62.
