There are four major changes- proposed: <br /> 1.. addition of definitions of road types that coinside with N.C. D.O.T. <br /> ' definitions <br /> 2. definition of a lot of record in reference to subdivision requirements <br /> 3. revisions to road rights of way to coinside with revised N.C. D.O.T. <br /> standards (this also allows us to propose a reduction of private road <br /> right of way requirements) <br /> 4. deletion of Section VII Variances <br /> • <br /> IMPPCT The addition of the road types will make the Subdivision Regulations • <br /> definitions the same as the EePartment of 'Transportation, which will <br /> facilitate understanding.. The lot of record concept is used to determine, <br /> the administrative procedure a subdivision must go through for approval. <br /> The Department 9f Transportation has recently reduced the right of way <br /> requirements for secondary roads. The proposed changes reflect the new <br /> requirements. The requirements for private road rights of way have also <br /> been reduced.. The section that sets out variance procedures should not <br /> have been included in the Subdivision Regulations. The State enabling <br /> legislation does not. allow variation from the specific standards of the <br /> Subdivision Regulations; therefore, it should be deleted. <br /> RoOMIENDATION: Planning Board recommends approval of the proposed changes to the Subdivision <br /> Regulations with the exception of the variance section which was recommended <br /> to be referred back to the Planning Staff. <br /> „ <br /> Planning Staff recommends approval. <br /> :T. •7. <br /> • . <br /> • ," • <br /> . • • : • <br /> ;`. <br /> • , <br /> " <br />
