This question had been raised at the Planning Board meet- <br /> ing on June 21, 1982 and was again asked by a citizen at the public hear- <br /> ing on July a, 1982. <br /> Special Use Permits may allow commercial uses in residential areas <br /> and they co through substantially the same review process as rezoning <br /> requests, Therefore, the Planning Board feels that Special Uses are <br /> arr2ndrmts to the Zoning Ordinance and came under the requirements of <br /> that article of the Ordinance. If they are considered amendments then <br /> there should be a one year waiting period after denial of an applica- <br /> tion. <br /> The motion was: Toe Planning Board has serious questions about the <br /> legality of a reconsideration of the Special Use Permit request for Buck <br /> Mountain Development at this tine.
