DEFINITIONS <br /> For he purposes of this ordinance certain terms or words used ( <br /> herein shall be interpreted as follows: <br /> - The word "shall" is always mandatory. <br /> - Terms not herein defined shall have the meanings customarily <br /> assigned to them. - . _ _ <br /> , <br /> Agricultaral Advisory Board Advisory body on agricultural preservation <br /> activities in Orange county. The Board is composed of one voting <br /> membiar of each voluntary agricultural, district and nine other Orange <br /> County farm people appointed at large by the Board of County Commis- <br /> sioners, <br /> Appraisal Determination of the market value or true value in money of <br /> property. <br /> I <br /> Assessment Fixing of tax value of property. The Machinery Act requires <br /> thatlproperty be taxed at full appraisal value, except where property <br /> by law is classified for taxation on a different basis (See N.C. <br /> Preferential Taxation Law). <br /> Critical Areas Land which is highly erodible and where vegetation is <br /> difficult to establish with normal procedure. Areas identified by <br /> the Soil Conservation Service as exhibiting these problems are to <br /> . ._ <br /> be addressed by approved Soil Conservation Service erosion control: , ( <br /> i <br /> measures. <br /> Deffered Taxes Difference between taxes paid on the use value and taxes <br /> thatlwould have been paid on the market value of a bona fide farm <br /> as provided for in the Orange County Farm Preservation Program <br /> (See Market Value, Use Value, N.C. Preferential Taxation Law, Orange <br /> County Farm Preservation Program), <br /> Development Rights Agreement Agreement whereby owner would retain complete <br /> owneOhip of the land, but agrees to use the land in a manner which <br /> would qualify for participation in the program. <br /> I <br /> Eminent Domain The authority of a government to take, or to authorize the <br /> takilg of private property for public use subject to just compensation <br /> for any taking. <br /> I <br /> Erosion Control Procedures, measures, structures or devices which serve <br /> as the means to control the wearing away of land surface by the action <br /> of wilnd, water, gravity, or any combination thereof. <br /> I <br /> Farm, Bona Fide As specified in General Statutes 105-277.3, agricultural <br /> land,' forestland or horticultural and that qualifies under the existing <br /> N.C.
