a) Deferred taxes shall be payable if <br /> (1) the owner conveys the property to other than wife, <br /> child or sibling; <br /> i(2) property ownership passes to other than enumerated family <br /> members by will or intestacy; <br /> ,(3) property ownership passes to or from a corporation from <br /> I or to anyone other than principal stockholders; <br /> (4) property loses eligibility. <br /> b) The tax for the year of disqualification shall be computed as if <br /> property was not classified for that fiscal year. Taxe'b for the <br /> three preceeding fiscal years shall be immediately payable with <br /> interest. If only a portion of the land becomes ineligible, a <br /> determination shall be made on the amount due. Upon payment of <br /> deferred taxes for the three years immediately proceeding dis- <br /> ualification, all liens shall be extinguished. <br /> c) Failure to notify the Orange County TaX Supervisor Of a change <br /> regarding the land benefitting from classification and participation <br /> in the program shall be subject to a penalty of 10% of the total <br /> amount of deferred taxes plus interest for each listing period for <br /> Which failure to report continues. <br /> ARTICLE 7. AMENDMENT OF THE ORDINANCE <br /> a) This ordinance may be amended by formal action of the Orange <br /> County Board of Commissioners. <br /> b) proposals to amend, supplement or repeal any of the articles con- <br /> tained herein may be initated by the Board of County Commissioners, <br /> Orange County Agricultural Advisory Board, Orange County Planning <br /> Board or by petition of any interested persons. All such proposals <br /> hall be referred to the Agricultural Advisory Board and then to <br /> the Orange County Planning Board for consideration and recommendation. <br /> The Planning Department shall make an analysis of the application <br /> for amendment and prepare a recommendation for consideration by the <br /> Agricultural Advisory Board, Planning Board and Board of County <br /> COmmissioners. <br /> 1 <br /> c) A public hearing shall be held by the Board of County Commissioners <br /> before adoption of any proposed amendment to the ordinance. Notice <br /> of the public hearing shall be published in a newspaper of general <br /> circulation in the County stating the time and place of such hearing <br /> and the substance of the pro:ose amendment. <br /> d) The Board of Commissioners shall not consider the enactment of the <br /> proposed amendment until it has received recommendation of the <br /> Planning Board. <br /> 1 <br /> ARTICLE B. SEPARABILITY <br /> If any section, subsection, sentence, clause, phrase or portion of <br /> this ordinance is for any reason held invalid or unconstitutional <br /> bY any court of competent jurisdiction, such portion shall be deemed <br /> a! separate, distinct and independent provision and such holding shal" <br /> not affect the validity of the remaining portions. <br /> 7 <br />
