„ . <br /> . , . <br /> • <br /> r •!• <br /> 4.2 Tasks of the Agricultural Advisory Board <br /> The Agricultural Advisory Board shall be responsible for the <br /> following tasks: <br /> a) Review and recommend approval of agreements forming Voluntary <br /> Agricultural Districts to the Orange County Board of Commissioners. <br /> b) Periodic review of the Orange County Farm Preservation Program <br /> and recommendation of necessary changes to the Board of County <br /> Commissioners. <br /> c) Holding mandatory public hearings on the impact of public projects <br /> and the use of eminent domain on agricultural lands and activity <br /> and forwarding of the results to the governing body of the agency <br /> Proposing such action, to the N.C. Commissioner of Agriculture <br /> and to the Board of County Commissioners. <br /> d) Review of major private developments affecting County agriculture <br /> as determined by the Planning Board and referred to the Agricultur, <br /> Advisory Board aad forwarding of report and recommendations on <br /> these projects to the Planning Board and Board of County <br /> Commissioners. <br /> ARTICLE 5. APPLICATION FOR AND ADMINISTRATION OF TAX RELIEF <br /> a) Application for and administration of tax relief under the Orange <br /> County Farm Preservation Program shall be as provided in C.S. 105-2 71 <br /> b) Payback schemes under the Orange County program are governed <br /> by GS. 105-277.4. For Classes C and D there are additional pay- <br /> back periods of 5 years for the Class C additional 10% tax abate- <br /> ment and 10 years for the Class D additional 20% tax abatement. <br /> . . <br /> c) No payback of tax benefits except as required by the N.C. <br /> Preferential Taxation Law will by applicable following <br /> expiration of the development rights agreement. <br /> ARTICLE 6. COMPLIANCE, VIOLATIONS, PENALTIES AND REMEDIES <br /> 6.1 <br /> Compliance <br /> Any farmland owner receiving benefits of classification and <br /> participation in the program who fails to act in accordance <br /> With the program requirements and terms and other applicable <br /> regulations shall be deemed in violation of this ordinance <br /> and subject to penalties specified in Section 6.2. <br /> 6.2 Violations, Penalties and Remedies <br /> In addition to any other remedy available to Orange County <br /> by law, Orange County is empowered to institute any appropriate <br /> action or proceeding to restrain or prevent violation of the <br /> ordinance as specified in G.S. 105-277.4: <br /> 6 <br /> 1 <br />
