The property to be rezoned is located <br /> in an area characterized by residential and small scale commercial <br /> uses. The property fronts on both an arterial (US 70 BYPASS) and <br /> a collector road (SR 1562) as classified in the Orange County Land <br /> Use Plan. <br /> The property to be rezoned is located in an area designated Rural <br /> Residential on the Orange County Land Use Plan. In addition the <br /> property is located within the designated Eno 1 (Law's Store) Rural <br /> Neighborhood Activity node. The NC-2 zoning district is appropriate <br /> at a Rural Neighborhood activity node as indicated on the Plan <br /> CategoriE - Zoning District Matrix in the Orange County Land Use <br /> Plan. <br /> A Rural Neighborhood activity node is described in the Land Use Plan <br /> as follows: <br /> Land focused on designated road <br /> intersections within a Rural <br /> Residential or Agricultural Resi- <br /> dential area that is appropriate <br /> for small-scale commercial uses <br /> characteristic of "Mom and Pop" <br /> convenience stores and gas stat- <br /> ions. <br /> Any new uses proposed for this type of activity node are evaluated <br /> according to certain locational criteria. Of the applicable lo- <br /> cational criteria the most critical criteria for this rezoning are <br /> soil conditions, transportation system, existing land use and pop- <br /> ulation density. The proposed rezoning conforms with the later <br /> three locational criteria. The Orange County Health Department has <br /> determined that the property is unsuitable for an on-site sewage <br /> disposal system. This condition does not conform with the soil con- <br /> ditions locational criteria which concerns suitability for on site <br /> sewage disposal systems, <br />
