��}-- <br /> ^^° � <br /> He further cited an advertisement which appeared in the Chapel Hill News- <br /> paper, May 9, 1982, which listed land for sale in the Cheeks Township near the <br /> two sites referred to in the County Airport Site Study. He cited the Land Use <br /> Plan Goal 12 in support of the location of an airport along 1-85. He urged the <br /> Commissioners to consider a "County General Aviation Airport, owned and operated <br /> by the public, financially accountable and financially responsible." <br /> Mr. Simpson also cited the National Agricultural Lands Study: The Protection <br /> of Farmland: A Reference Wide Book for State and Local Government, pp. 34-35, to <br /> introduce the concept of the "impennaooe syndrome" which results when "significant <br /> development is introduced into a primarily rural area." Mr. Simpson asked that <br /> the Board of Commissioners exercise its legal rights and deny the Buck Mountain <br /> Special Use Permit Request for the Midway Airpnrt "andthereby earn for Orange County <br /> a special place in the history of the protection of North Carolina's agricultural <br /> lands," He urged denial under Article 8.2.2 a-c of the Zoning Ordinance, <br /> Mr. Kizer: Asked if Mr. Simpson would submit the documpnts he had cited for <br /> record as evidence. Mr. Simpson responded yes /8ocuments too bulky to reproduce <br /> in the Minute Book are on permanent file in the office of the Clerk to the Board]. <br /> Mr. Ralph Warren, Route 1, Bingham Township: Said he had three concerns <br /> regarding this proposal. 1) Is this reapplication a valid one under the Zoning <br /> Ordinance? Mr. Warren cited Articles 20 and 8 from the Zoning Ordinance which he <br /> believes prohibits the submission of a " 'same or similar' application" within one <br /> year after denial or withdrawal of the previous application. 2) Mr. Warren feels <br /> that by presentation of " 'findings of fact' and recommendations" prior to the public <br /> hearing on the part of the Planning Staff, some issues may be raised by the citizens <br /> which have not been considered by Staff. 3) Mr. Warren cited Article 8.2.2 of <br /> the Zoning Ordinance as saying the Board of Commissioners must find that the 3pcial <br /> Use Permit, if 'ranted, will not cause a "negative impact." /Mr. Warren's complete <br /> remarks are also attached to these Minutes on page-a/41 <br /> Commissioner Whitted: Noted that the legal questions Mr. Warren raised would <br /> be researched by County Staff. <br /> Mr, Dan Eddelman; Bingham Township: Said he lives just off the southern end <br /> of the proposed runway. He continued by saying that he had three points to discuss: <br /> 1) The Land Use Plan for Bingham calls for Agricultural/Residential Use; this <br /> Township had 20% of the building permits issued in the County in the previous year <br />
