Pat CraiBord, (chair), John Wilson, David Shanklin, <br /> Steve Kizer, Sally Boericke, Logan Irvin, Tan Bacot, <br /> Hazel Lunsford, Nancy Lamlo <br /> S=: - Jim Polatty, Pick Cannity, F!red IA , Eddie Kirk, <br /> Keith Fosemoad <br /> AGWM 17EM 10: Paul Kempa - Ettzoning at the intersection of US 70 and <br /> Palmers Grove Church Road. Cannity described the <br /> Mirosal explaining that there was a possibility of two <br /> separate lots being created from the property. Mike <br /> Parker, Keirpa's representative, passed cut maps 6ianng <br /> nearby camnarcial uses. He told the Board that op- <br /> position to the rezoning voiced at the hearing was <br /> based an the belief that the intersection has a high <br /> rate of traffic accidents. Parker presented a =qnter <br /> printout from MT that listed me major accident at the <br /> intersection in the last 3 years. He added that other <br /> intersections almg U.S. 70 Fast have higher accident <br /> rates. Parker told the Board that the developers has <br /> no burediate plans for the property until an alternate <br /> waste system is approved. Boericke asked if 5 acres <br /> was the maximn total for comiercial development with- <br /> in the node. Cann ty told the Board that zcning lots <br /> had been created around the other uses, but that the <br /> Kempa retuning wruld take up most of the remaining acres <br /> allotted for the nods. A man from the audience told the <br /> Board that some erosion damage had been caused by trees <br /> being cut down on the property. QUuAty stated that <br /> until the stmps were removed or the lot cleared the <br /> County could not enforce the erosion control ordinance. <br /> Shanklin remarked that if the property was rezoned cone <br /> erosion stabilization would be done by the required. <br /> Polatty told the Board that the neighbors had not opposed <br /> the land use plan designation of a comtercial node at the <br /> intersection during the land use plan hearings. <br /> Barbour spoke fxom the audience that the neighbors might <br /> not have kna.4n that the intersection had been proposed as <br /> a conmercial area. Parker told the Board that the only <br /> "Logical." use of property would be coavercial. <br /> YMON: Kizer roved that the Board rec=mnd approval of the Paul <br /> Kempa remning request. Be= seconded. <br /> Irvin said that he was concerned that if the property were <br /> removed without se-wage disposal that other comerciaL <br /> proposals might be encouraged. Polatty stated that the <br /> applicants had acted according to the adopted land use plan. <br /> If the land use plan were to be amended, then so be it <br /> but the applicants should not be penalized for having <br /> acted in good faith an an adopted plan. <br /> VOM. is favor of =tion.
