May 24, 1982, at 7:30 P.M. in the Superior Courtroom, Orange County Courthouse, <br /> q° Hillsborough, North Carolina. <br /> 10, Commissioners present: Chairman Richard E. Whitted, and Commissioners <br /> Il, Norman Gustaveson, Shirley E. Marshall , Norman Walker and Don Nillhoit. <br /> 12. Commissioner Whitted changed the order of the agenda in order that the <br /> 13. public hearing be held first. <br /> 114.. D. JOINT PUBLIC HEARING WITH THE ORANGE COUNTY PLANNING BOARD <br /> 15. Planning Board members present: Chairwoman Pat Crawford, and Members <br /> 16. Sally Boericke, Logan Irvin, Nancy Laszlo, Hazel Lunsford and John Wilson. <br /> 17^ The Public Hearing was chaired by Ms. Crawford. <br /> 18. a. Tommy Merritt Property Rezoning: Mr. Eddie Kirk made the presentation <br /> 19, for the Planning Staff (see page for summary of Planning Staff findings). <br /> 20" He noted that the rezoning request is in conformance with the Land Use Plan. <br /> 21" There were no persons who wished to speak in favor of or opposed to the rezoning <br /> 22. request. Mr. Rick Cannity told the Boards that Mr. and Mrs. Robert Vanhook were <br /> 23~ unable to be present this evening and had asked that he convey their concerns <br /> 24, regarding commercial development of this area at the interection of St. Mary's <br /> 25° Road with Highway 70' They prefer that this area remained zoned residential <br /> 26, and that commercial development occur along Highway 86' <br /> 27, b. Paul Kempa Property Rezoning: Mr. Eddie Kirk made the presentation <br /> 28. for the Planning Staff (see page for a summary of Planning Staff findings). <br /> 29. Ms. Crawford asked those in favor of the pr0ject to speak first. <br /> 30. Mr. Michael Parker--Attorney for Paul Kempa--said the site would not <br /> 31, perk and was unusable for almost anything except a commercial venture. He said <br /> 32° access would be limited to Palmer's Grove Road. <br /> 33, Those opposed to the proposed rezoning spoke in turn. <br /> 34, Mr, Harris--Chairman of the Eno Advisory C ounc il is opposed to the <br /> 35^ latitude permitted in rezoning property. He preferred to have this considered <br /> 36, as a Planned Development where the individual who owns the property could carry <br /> 37° out his plans but not have commercial activity. <br /> 38. <br /> 19. <br />
