2 <br /> The County Attorney has reviewed the agreement and <br /> recommends that Section 5 - Project Budget and <br /> Accounting Procedure - be revised to read as follows: <br /> The local governments will pay the Consultant $20,000 <br /> for services herein described. Each jurisdiction upon <br /> approval of the agreement agrees to pay $5,000 to <br /> Durham City or County which will disburse the funds to <br /> the Consultant. If the services are not performed <br /> according to this agreement, funds paid to Durham City <br /> or County will be proportionally returned to the local <br /> governments. Funds will be disbursed to the Consultant <br /> upon authorization by the Durham City-County Planning <br /> Department and in accordance with the following <br /> schedule: <br /> 25% upon agreement execution; <br /> 25% upon completion of the first draft; and <br /> 50% upon adoption of Plan by Advisory Committee <br /> and submission of camera-ready booklet. <br /> If additional services are required beyond the scope of <br /> this agreement, the Consultant shall be hired at an <br /> hourly rate of $50.00 to perform services agreed upon <br /> with the local governments. <br /> In addition to the above changes, the County Attorney <br /> noted that all names of the governing board clerks <br /> should be provided on the agreement. <br /> RECOMMENDATION: Authorize the Manager to execute the agreement for <br /> professional services and forward the County's share of <br /> the project cost to Durham City or Durham County <br /> following final review and approval of the agreement by <br /> the County Attorney. <br /> A report will be presented at the August 15, 1989 <br /> meeting of the Board of Commissioners regarding <br /> appointments to the Advisory Committee. <br />
