• <br /> 11 <br /> Provided, however, private roads may be allowed in a • <br /> subdivision where, in the judgment of the Planning Board <br /> and with the approval of the Board of County <br /> Commissioners, it is found that the nature and location <br /> of the subdivision are such that a private road is <br /> justified. <br /> (The road is located in what is a rural area that is <br /> experiencing some residential development usually on <br /> larger residential lots. Its location, at the <br /> intersection of two unpaved roads, maintains the rural <br /> character of the area. ) <br /> In determining whether to permit private roads in <br /> subdivisions, the following design features will be <br /> considered: <br /> 1 . The location and design of the subdivision is such <br /> that it clearly preserves the rural character of <br /> the County through: <br /> a. The provision of lot sizes and building <br /> setback lines greater than required by <br /> ordinance provisions; <br /> Lot sizes proposed on the preliminary plan are <br /> greater than 40,000 square feet as required by the <br /> ordinance. Four lots are larger than 3 acres, <br /> seven lots are between 2 and 3 acres, and five lots <br /> are between 1 and 2 acres. <br /> Building setback lines as indicated are the same as <br /> required in a zoned township, however, in an <br /> unzoned township they would be larger than required <br /> by ordinance provisions. There is a 50 foot buffer <br /> proposed along the public roads which would provide <br /> a larger setback. <br /> b. The retention and/or provision of landscaping <br /> and use of clustering of dwelling units to <br /> screen the view of the subdivision from public <br /> roads and/or maintain a wooded or forested <br /> character; <br /> (Existing woods would be maintained as much as <br /> possible. A 50 foot buffer is proposed which would <br /> help to screen the view and/or maintain the <br /> existing rural character. ) <br /> c. The maintenance of scenic views, including <br /> vistas of open farmland and/or forested hills <br /> and mountains; and/or <br /> (The maintenance of existing vegetation, larger <br /> than minimum lot size and lot design will help <br /> maintain the existing rural character. ) <br />
