10
Provided, however, private roads may be allowed in a
subdivision where, in the judgment of the Planning Board
and with the approval of the Board of County
Commissioners, it is found that the nature and location
of the subdivision are such that a private road is
justified.
(The road is located just outside the Rural Buffer in
Bingham Township. This area is considered to be rural;
however, residential development along Dodsons
Crossroads has increased during the last three years.
Most other subdivision roads in the area are private and
unpaved, including Sunnyfield, Pickards Mountain,
Western Park, Covered Bridge, Five Forks, Forest Knolls,
and Twin Streams. )
In determining whether to permit private roads in
subdivisions, the following design features will be
considered:
1. The location and design of the subdivision is such
that it clearly preserves the rural character of
the County through:
a. The provision of lot sizes and building
setback lines greater than required by
ordinance provisions;
(Building setbacks of 100' and 75' are proposed.
All of the lots which access the private road are
larger than the 0.92-acre minimum size required.
The smallest lots exceed the minimum by 0. 77 acre.
Six of the remainingllots are more than twice the
required lot size. )
b. The retention and/or provision of landscaping
and use of clustering of dwelling units to
screen the view of the subdivision from public
roads and/or maintain a wooded or forested
character;
(The entire site is wooded. The private road
justification states that "the wooded character
will be maintained" with clearing limited to 20% of
each lot by restrictive covenants. In addition,
the larger setbacks will also help screen the view
of structures from the State road. No clustering
of units is proposed. )
c. The maintenance of scenic views, including
vistas of open farmland and/or forested hills
and mountains; and/or
(Not applicable. )
d. The clustering of dwelling units to preserve
wildlife, botanical, historic, archaeological
and/or recreation sites;
